CAS # i <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR <br />AN OVERSIZED ACCESSORY BUILDING; <br /> CASE OF STEVEN SCHWAAB <br /> By: Amy Geisler, Associate Planner <br /> <br />Background: <br /> <br />The City has received an application from Steven Schwaab for a conditional use permit to exceed <br />the accessory building size restrictions established in City Code on the property located at 8732 <br />168th Ave. NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site layout <br />c) Proposed building graphic <br />d) Proposed findings of fact <br />e) Proposed conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />The subject property is approximately 0.8 acres (35,811 square feet) in size and is located outside <br />the Metropolitan Urban Service Area (MUSA). According to City Code, the property is eligible <br />for 1,488 square feet of accessory building space. <br /> <br />The proposed building will be 1,120 square feet (28' x 40'). in size. Combined with the existing <br />attached garage (529 sq. ft.), the applicant would have 1,649 sq. ft. in accessory building space. <br />This results in an overage of 161 square feet. The applicant would like to exceed the size <br />restriction in order to construct a detached accessory building that would accommodate the <br />storage of private use vehicles and equipment. <br /> <br />The proposed accessory building will be located in the rear yard, and will meet and/or exceed all <br />setbacks established in the R-1 Rural Developing District. <br /> <br />City Code requires a 10-day waiting period between the Planning Commission action and the <br />City Council action on Conditional Use Permits. Because of Staff errors in processing the <br />applicant's building permit application, Staff is proposing to present this case to the City Council <br />on November 10 rather than November 25. This results in a waiting period of 3 days versus the <br />l0 days required. The City Council will be asked to reduce the 10-day waiting period. <br /> <br /> <br />
