for removing litter from the site a minimum of twice weekly.'

Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer, Shumway,
Zimmerman, Hendriksen, Howell and LaDue. Voting No: None.

Discussion With Mr. Larry Hickman ReEardinE Plants And Thin~s:

Mr. Hickman was present and referred to the question regarding the setback
distance of his new accessory structure at Plants and Things; at the time, he
did receive approval from City Building Inspector Walter Johnson. When the
building footings were being installed, 3 persons from Ramsey stopped by to
measure distances and stated the distances were up to code.

Commissioner Hendriksen stated that he was one of those persons that stopped by
after construction was completed and his comment was that in just stepping off
the distance, it seemed close enough to code considering the building was
already built.

Mr. Hickman stated that at the time footings were being installed, he was told
by Mr. Wirz that the distances were O.K.

Commissioner Deemer inquired if Mr. Hickman ever provided the building
inspector with a lot survey.

Mr. Hickman replied that he did provide a lot survey. Mr. Hickman also stated
that professional surveyors measured and they determined that the road is off
by 10'. Mr. Hickman stated that he is in Ramsey to do business and he would
have moved his building 3' to please the city had he been instructed to do so
at the beginning of construction.

Commissioner Deemer stated that Mr. Hickman's construction did get caught in
the middle of a change in building inspector staff at the city. Technically,
Mr. Hickman cannot sell his property until this matter is cleared up; it is a
cloud on his title.

Commissioner Zimmerman advised Mr. Hickman that for any future constuction he
hire professionals to be sure building placement is proper; city building
inspector can require a certificate of survey but it is the property owner's
responsibility to be sure the buildings are properly placed.

Mr. Hickman replied that he was told that he did not need a certificate of
survey and the building use was for warehouse; the building is now being used
for showroom containing duplicates of what is displayed in the main showroom.
Mr. Hickman stated that he would have built in Elk River had he known he would
have all these problems in Ramsey.

Chairman Peterson inquired if Mr. Hickman's operation has an off-street parking
plan.

Mr. Hickman replied that he has 38,000 square feet of parking area.

Chairman Peterson stated that code requires a parking area that is blacktopped~
striped and property designated as parking area.
July 8, 1986
