CC Regular Session 4. 4. <br />Meeting Date: 12/11/2012 <br />By: Tim Gladhill, Community Development <br />Information <br />Title: <br />Consider Request for Extension to Site Plan Approval of Legacy Christian Academy <br />Background: <br />On November 23, 2010, the City Council approved the Plat entitled ALPHA DEVELOPMENT and the site plan of <br />Legacy Christian Academy. On May 10, 2011, the City Council approved a revision to the Development Contract <br />for the previous approvals, which among other items, extended the timeframe to complete Stage I and Stage <br />II Improvements as required by the Subdivision Code. At that time, it was anticipated that the Stage I Improvement <br />would be completed in 2011, and that the required improvements as part of the site plan approval of Legacy <br />Christian Academy would begin parallel or soon after completion of the Stage I Improvements, with completion of <br />work in the spring/summer of 2012. At that time, it was anticipated that the facility would open in the fall of 2012. <br />After initial discussions, Legacy Christian Academy then stated they had hoped to complete the project in <br />anticipation for a fall 2013 opening. <br />Observations: <br />To date, although a Building Permit has been submitted for review, a Building Permit has not been issued to <br />commence work. However, the City did issue a Grading Permit, and the preliminary grading on the site to support <br />the Legacy Christian Academy has been completed (parallel to the the construction of the extension of Bunker Lake <br />Boulevard). However, since a Building Permit has not yet been issued and it is evident that the project will not be <br />completed as originally scheduled for mid-2013, the Developer is requesting an extension to site plan approval <br />through December 31, 2013. At that time, the City can re-evaluate the status of the project or consider another <br />extension to site plan approval. <br />As the City Council may recall, the City Council approved a Comprehensive Plan and Zoning Amendment to guide <br />this parcel as Public/Quasi-Public. Under this district, Permitted Uses include Government buildings and facilities, <br />Public recreational facilities, Private recreational facilities (including golf courses), Schools (public and private), <br />Private utility substations, and Municipal utility substations. Any other use (such as residential or commercial) <br />would require approval of the City Council. <br />Staff has reviewed the Account Status for the Property, and it appears that the Owner is current on all taxes and <br />assessments at this time. <br />Recommendation: <br />Staff recommends that the City Council adopt the resolution granting an extension to site plan approval of Legacy <br />Christian Academy located at 8200 Bunker Lake Boulevard until December 31, 2013. <br />Funding Source: <br />The Developer is responsible for all costs associated with review of the Application. <br />Council Action: <br />Motion to adopt the resolution granting an extension to site plan approval of Legacy Christian Academy located at <br />8200 Bunker Lake Boulevard until December 31, 2013. <br />Attachments <br />
