approval.' <br /> <br />The Commission expressed concern with Item #9 of the proposed agreement and the <br />city's ability to trace ownership of the plots in the event of owner death and <br />no heirs; Commission requested that the City Attorney research this issue. <br /> <br />Chairman Peterson expressed concern for the safety and security of the <br />neighborhood with respect to vandalism activity; inquired if the cemetery will <br />be fenced and locked. <br /> <br />Mr. Sylvester stated that gate location has not yet been determined but <br />vehicular access to the cemetery after hours will not be allowed. <br /> <br />Item #12 shall be added to the permit agreement and read as follows: <br />'That some form of security to restrict unauthorized vehicle access to <br />the area shall be included in the development plans.' <br /> <br />Item #13 shall be added to the permit agreement and read as follows: <br />'That the cemetery will be open to any persons requesting to purchase <br />burial space.' <br /> <br />Mr. Sylvester noted that the cemetery charter is leaning towards allowing <br />ground level grave markers only for maintenance and aesthetic purposes. There <br />are no plans for any structures to be built within the cemetery proper. <br /> <br />Motion by Commissioner Howell and seconded by Commissioner Deemer to recommend <br />City Council approve of the request by the Cross of Hope Lutheran Church and <br />Mr. Bob Sylvester for a conditional use permit to establish and operate a <br />cemetery at 5730 - 179th Lane NW contingent upon the appicants entering into a <br />conditional use permit agreement, as amended, with the City. <br /> <br />Amendment by Commissioner Zimmerman and seconded by Commissioner Deemer <br />recommending that the City not become involved in constructing an access road <br />to the cemetery proper. <br /> <br />Amendment carried.
