Mr. Peterson noted that the City
Staff is recommending park dedication being required on all 18 lots and that the Planning and
Zoning Commission is recommended park dedication being required on the 17 new lots and
waiving park dedication on the original homestead lot in lieu of the outlot being dedicated for
drainage. Mr. Peterson requested an explanation of the City's current park dedication ordinance.

Mr. Otto replied that on minor subdivisions of three of less lots, park dedication is due on the new
lots being created. On full subdivisions, which is what applies to Chestnut Pond Addition, park
dedication is due on the gross area or the total number of units being subdivided, whichever is
greater.

Sylvia Frolik stated that the City has the authority to require park dedication and drainage
easements on plats; these are two separate issues and the City should not set a precedent of
accepting drainage easements in lieu of park dedication.

Motion by Councilmember Peterson and seconded by Councilmember DeLuca to approve the
preliminary plat for Chestnut Pond Addition as per the City Engineer's letter dated July 31, 1990
with the exception of soil borings and requiring dedication of Outlot A for drainage and utilities and

CITY COUNCIL/AUGUST 14, 1990
