Mr. Kiefer stated that he called the City Hall asking for copies of material that would reflect that the
cost of services to the three units outside the project area was deducted from the total project cost.
He has not yet been provided with those materials.

Mayor Reimann advised Mr. Kiefer to contact the City Administrator for the materials he is
requesting. Mayor Reimann inquired if the Rivlyn project qualifies for 50% City participation.

Mr. Hartley replied that whether or not the Rivlyn Avenue project qualifies for 50% participation
on the part of the City is a Council decision and it will set a precedent. Mr. Hartley did note that
Rivlyn Avenue was in a state of disrepair and had the sewer and water improvements not been
brought to that area, it clearly would have needed at least street reconstruction and would have
received 50% City participation.

Councilmember Pearson stated that he thought there was a policy in place whereby the residents
would not be assessed until they connected to the services.

Mr. Hartley replied that in January of 1990, the City Council passed an Ordinance setting a policy
whereby connection would be required when services are available and if services are currently
available, the properties have two years to connect from the date of 1990.

Councilmember Pearson stated that one of the property owners is an elderly couple and the
assessment would be a financial burden on them.

Mr. Hartley replied that the State of Minnesota and the City of Ramsey provide for senior citizen
deferral of assessments. Deferred assessments accumulate interest and will be levied against the
property at some time in the future, but the property owner does not have to lose the property
because of the special assessment.

Mayor Reimann inquired as to what amount would reflect 50% of the road construction portion of
the project.

Mr. Raatikka stated that 50% of the road construction would probably amount to $9,000.00.

Motion by Councilmember Peterson and seconded by Councilmember Cich that the City will
participate in 50% of the cost for the portion of the Rivlyn Avenue project relating to road
construction.

Further discussion: Mr. Kiefer stated that to fully satisfy himself, he would like to see an itemized
list of the properties to be assessed.

Jack Newcomb - 6301 Rivlyn Avenue N.W. - Mr. Newcomb stated that there was a revision in the
design plans for the utilities and inquired if the City subtracted the cost of the trunk lateral
connection from Front Street to where Rivlyn Avenue is now built. Mr. Raatikka replied that the
cost has been deducted from the project cost. He stated that the amount will be recouped through
trunk costs and S.A.C.'s when people connect.

Mr. Keifer stated that according to his calculations, the project cost went over by 12% and
Minnesota has a law on the books that says any estimate over 10% requires notification to the
affected property owners. Mr. Raatikka replied that the City Charter states that the assessment
cannot be more than 10% higher than the estimate quoted in the feasibility study. The actual cost in
this case is somewhat less than the estimate provided.

City Council Public Heating / September 5, 1990
Page 2 of 4
