Councilmember DeLuca stated that in his opinion, that before any decision is made, the City Council needs to resolve the issue of whether or not to allow use of the buffer area regardless of Metro Council and Anoka County's position. Councilmember DeLuca stated that his position is that if the City allows or relinquishes its ability to have a non-use of a buffer area, that it will be setting a precedent that will allow the potential selection of Site "P". Councilmember DeLuca stated that he feels the intent of legislation regarding buffer areas was not specifically to maintain a moratorium on the land but to do exactly what a buffer says - protect or shield between two different areas. Councilmember DeLuca noted that he is not in opposition to yard waste composting but he is opposed to allowing a use that would jeopardize Ramsey's position as it relates to the selection of Site "P". Councilmember DeLuca stated he is not in favor of relinquishing the non-use of that buffer area until after the landfill site selection is made. Edward Morsefelder stated that WMMI is before the City Council with an application for a conditional use permit based on industrial zoning. The City of Ramsey has a conditional use permit ordinance that allows applicants to come before them and request a conditional use permit and if the applicant meets the conditions of that cup ordinance, then the granting of the cup is appropriate. Mr. Goodrich noted that in establishing buffer areas, the legislature indicated that the related legislation would take precedence over local zoning. Mr. Goodrich stated that if the City Council is contemplating following Councilmember DeLuca's direction, it would be his recommendation that this case be tabled to allow him a time frame in which to review the findings of fact so that the appropriately reflect the action the City Council is contemplating and also take into consideration Mr. Morsefelder's comments regarding the buffer area issue. Motion by Councilmember DeLuca and seconded by Councilmember Pearson to table WMMI's request for a conditional use permit for a yard waste compost facility until the next regular meeting of City Council to allow the City Attorney time to review the proposed findings of fact. Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich and Peterson. Voting No: None. Case #6: Comprehensive Plan Amendment Mr. Otto recalled that last year the City Council adopted a four-in-forty density policy. That policy was in response to a request to expand the MUSA boundary. An amendment to the comprehensive plan was submitted to Metro Council and there was an approved expansion of the MUSA boundary by 200 acres and a conditional approval for an additional 205 acre expansion. Mr. Otto stated that at this time, City Staff is requesting Council approval to submit the amendment to the comprehensive plan to meet Metro Council's criteria for the additional 205 acre expansion of the MSUA area. Motion by Councilmember Pearson and seconded by Councilmember Cich to approve the comprehensive plan amendment and direct staff to submit same to Metro Council. Motion carried. Voting Yes: Mayor Reimann, Councilmembers Pearson, Cich, DeLuca and Peterson. Voting No: None. Case //7: Authorize Plans and Specifications for CDBG Improvements Mr. Otto recalled that at the last Council meeting, the City Council approved the reuse of CDBG funds for improvements in River's Bend Park.
