Councilmember DeLuca stated that in his opinion, that before any decision is made, the City <br />Council needs to resolve the issue of whether or not to allow use of the buffer area regardless of <br />Metro Council and Anoka County's position. Councilmember DeLuca stated that his position is <br />that if the City allows or relinquishes its ability to have a non-use of a buffer area, that it will be <br />setting a precedent that will allow the potential selection of Site "P". Councilmember DeLuca <br />stated that he feels the intent of legislation regarding buffer areas was not specifically to maintain a <br />moratorium on the land but to do exactly what a buffer says - protect or shield between two <br />different areas. Councilmember DeLuca noted that he is not in opposition to yard waste <br />composting but he is opposed to allowing a use that would jeopardize Ramsey's position as it <br />relates to the selection of Site "P". Councilmember DeLuca stated he is not in favor of <br />relinquishing the non-use of that buffer area until after the landfill site selection is made. <br /> <br />Edward Morsefelder stated that WMMI is before the City Council with an application for a <br />conditional use permit based on industrial zoning. The City of Ramsey has a conditional use <br />permit ordinance that allows applicants to come before them and request a conditional use permit <br />and if the applicant meets the conditions of that cup ordinance, then the granting of the cup is <br />appropriate. <br /> <br />Mr. Goodrich noted that in establishing buffer areas, the legislature indicated that the related <br />legislation would take precedence over local zoning. Mr. Goodrich stated that if the City Council <br />is contemplating following Councilmember DeLuca's direction, it would be his recommendation <br />that this case be tabled to allow him a time frame in which to review the findings of fact so that the <br />appropriately reflect the action the City Council is contemplating and also take into consideration <br />Mr. Morsefelder's comments regarding the buffer area issue. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to table WMMI's <br />request for a conditional use permit for a yard waste compost facility until the next regular meeting <br />of City Council to allow the City Attorney time to review the proposed findings of fact. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich and <br />Peterson. Voting No: None. <br /> <br />Case #6: Comprehensive Plan Amendment <br /> <br />Mr. Otto recalled that last year the City Council adopted a four-in-forty density policy. That policy <br />was in response to a request to expand the MUSA boundary. An amendment to the comprehensive <br />plan was submitted to Metro Council and there was an approved expansion of the MUSA <br />boundary by 200 acres and a conditional approval for an additional 205 acre expansion. Mr. Otto <br />stated that at this time, City Staff is requesting Council approval to submit the amendment to the <br />comprehensive plan to meet Metro Council's criteria for the additional 205 acre expansion of the <br />MSUA area. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Cich to approve the <br />comprehensive plan amendment and direct staff to submit same to Metro Council. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Pearson, Cich, DeLuca and <br />Peterson. Voting No: None. <br /> <br />Case //7: Authorize Plans and Specifications for CDBG Improvements <br /> <br />Mr. Otto recalled that at the last Council meeting, the City Council approved the reuse of CDBG <br />funds for improvements in River's Bend Park.
