Mrs. Harold Stoesz noted that there used to be a limit on the number of off-sale liquor stores <br />allowed in Ramsey and she suggested that the City also put a limit on the number of adult uses that <br />can be located within the community. <br /> <br />Doug Fountain inquired as to how the proposed zoning ordinance would be enforced and would it <br />be possible to direct the City's Police Department to visit the adult use sites daily and observe the <br />inventory. <br /> <br />Mr. Hartley replied that enforcement of any and all rules and regulations must be uniform. The <br />City cannot and will not select a particular use or particular individual or particular location and <br />selectively enforce its laws and regulations. This is the policy of the City Council and it is law. <br /> <br />Jim Gilbertson recalled that at one time the City restricted the number of off-sale liquor stores to <br />one per 5,000 of population. Now, that ratio has been exceeded, which says that establishing <br />restrictions didn't mean anything in Ramsey. The idea of limiting one adult use for every 10,000 <br />of population would be wonderful, but it would not mean anything in the City of Ramsey. <br /> <br />Ralph Smithers - 6560 - 153rd Lane N.W. - stated that if the City is going to have to allow adult <br />uses, then would it be possible to restrict other places from having adult magazines and videos <br />available since the opportunity to purchase those will be available through the principal adult <br />stores. <br /> <br />Dwight Martin asked if adult use businesses will have minimum building size and lot size <br />standards imposed on them. <br /> <br />Mr. Hartley replied that in all of Ramsey's zoning districts, there are certain lot size requirements <br />which would apply. <br /> <br />Mr. David Licht stated that the lot sizes which are proposed as part of the B3 zone are the same as <br />those established for the B-1 zone today. Within the Business Warehouse zone, he believes the lot <br />size requirement is one acre, which is the same as what is required in the I-1 Industrial zone today. <br />With respect to the building, there are no specified requirements placed on the building, other than <br />it meet the building code. <br /> <br />Mr. Mark Winger - 7610 - 168th Avenue N.W. - stated that the U.S. Constitution was written 200 <br />years ago and he believes that with some research, the City would find that the definition of <br />obscenity at that time is not what it is considered to be now and if this was taken into <br />consideration, there might be a different outlook on what is intended to be protected under the First <br />Amendment. <br /> <br />Mr. Goodrich stated that the City is proceeding on how the U.S. Supreme Court is interpreting the <br />U.S. Constitution today. The definition of obscenity was defined by the U.S. Supreme Court; not <br />by the City of Ramsey. <br /> <br />Mr. Douglas Fountain noted that part of the definition for adult use accessory defines it as an <br />allowable space area of 10% and inquired as to how someone arrived at that figure. <br /> <br />Mr. David Licht replied that the intent was to minimize what would be defined as adult use <br />accessory. If 10% of a business is adult use related, then that business is considered adult use <br />accessory.
