Case #6: Consider Introduction of Ordinances Extending Preliminary Plat,
Final Plat and Site Plan Agreement Time Limitations

City Attorney, Bill Goodrich stated he had been directed by City Council to prepare two ordinances
for the purpose of extending the preliminary plat and final plat and site plan development contract
time limitations. He had prepared such ordinances. The Subdivision Ordinance extends the
preliminary plat to final plat filing period to one year from date of approval and extends the final
plat filing period for a period of two years from the date of final plat approval. This is generally in
conformance with the State Statutes on this subject. The ordinance concerning site plans requires
the applicant to sign the development contract within 120 days of Council approval. There is no
State Statute governing this requirement, however, during discussion on October 23, 1990,. it was
determined that this would be an appropriate period of time for the developer to accomplish this
task.

Motion by Councilmember Cich and seconded by Councilmember DeLuca to introduce Ordinance
#90-XX which is an ordinance amending Sections 170.0310A and 170.0310C of the City
Subdivision Code relating to the time periods for filing of preliminary plats and final plats.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers Cich, DeLuca, Pearson and
Peterson. Voting No: None.

Motion by Councilmember Pearson and seconded by Councilmember Cich to introduce Ordinance
#90-XX which is an ordinance requiring that site plan development contracts be signed within 120
days of site/design approval and to direct City Attorney to amend proposed ordinance to provide
for extensions for the execution of site plan development permits.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers Pearson, Cich, DeLuca and
Peterson. Voting No: None.

Case ~7: Introduction of Ordinance Amending Licensing Provisions of the
City Code

City Administrator David Hartley asked that this case be tabled because he and City Attorney
Goodrich would like to make a couple provisions before it is presented to the City Council.

Motion by Councilmember Cich and seconded by Councilmember Pearson to table the introduction
of an ordinance amending Chapter 7 of the City Code.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers Cich, Pearson, DeLuca and
Peterson. voting No: None.

Case #8: Charter Commission Appointments

City Administrator, David Hartley stated that of the members of the Charter Commission, five have
terms that expired on May 11, 1989. The remaining four have terms expiring on May 11, 1991.
He stated there had been an advertisement for applicants placed in the Ramsey Resident last
September, but no applications were received. He explained that state law states a person can only
serve two terms.

Upon inquiry, Mr. Goodrich answered that he wasn't sure if it meant just two terms or if it meant
two consecutive terms.

Councilmember DeLuca asked what would happen if no one wants to serve on the Commission.

City Council/November 13, 1990
