CONSENT AGENDA <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Peterson to approve the <br />following items contained in the Consent Agenda: <br /> <br />1) Approve license applications. <br /> <br />2) <br /> <br />Adopt resolution approving accounts payable transactions for the period October 15, 1990 <br />through October 31, 1990 in the amount of $321,946.85. <br /> <br />3) Receive report of cash flows for period ending October 31, 1990. <br /> <br />4) Receive Landfill Tipping Fee and Expendable Trust Funds report. <br /> <br />5) <br /> <br />Approve request for a one year extension from October 31, 1990 to October 31, 1991 to <br />complete site improvements at Mad Mac's Auto Sales, 6750 Riverdale Drive N.W. <br /> <br />6) <br /> <br />Adopt resolution approving payment to Vincent G. Hicks and Michelle M. Hicks for <br />damages resulting from the extension of 153rd Avenue N.W. <br /> <br />7) <br /> <br />Receive letter from Anoka County Commissioner Natalie Haas Steffen regarding the <br />disposal of slag in the City of Ramsey and late night dumping at the landfill. <br /> <br />8) Approve change order no. 1 to Improvement Project #89-15. <br /> <br />9) <br /> <br />Adopt resolution approving pay estimate no. 3 (final) to Aero Asphalt, Inc. in the amount <br />of $5,447.14 for Improvement Projects g90-10 and #90-12. <br /> <br />Adopt resolution approving pay estimate no. 6 (final) to Annandale Contracting, Inc. in the <br />amount of $25,815.85 for Improvement Projects #87-27 and #89-14. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: Yard Waste Compost Facility CUP - Reconsider Term <br /> <br />Mr. Merland Otto, Hakanson Anderson stated that on October 23, 1990, the Ramsey City Council <br />approved a conditional use permit for a yard waste compost facility for Waste Management of <br />Minnesota. The term of the permit was set for 20 months with a performance review set for <br />September, 1991. Waste Management's legal counsel expressed concern with whether or not a <br />new CUP could be issued at the end of the 20 month term since Ordinance g90-5 would seem to <br />prohibit that. The current CUP application was submitted prior to the adoption of Ordinance #90-5 <br />and therefore, was not subject to this ordinance. Mr. Otto recalled that it was City Council's desire <br />to have fi~rn control regarding the term of the operation, however, it was not necessarily the intent <br />of the Council to preclude the applicant from obtaining a new CUP if the operation performed <br />satisfactorily. Waste Management of Minnesota is requesting Council to reconsider the term of the <br />approved CUP or an exemption to Ordinance 4/:90-5 for the purpose of avoiding a situation where <br />the operation would be prohibited beyond the initial 20 months. Mr. Otto reviewed the possible <br />options for resolving this matter and stated that Staff is recommending the modification of the CUP <br />to exempt the Permit Holder from specific sections of Ordinance #90-5 for a period of 54 months <br /> <br />Ed Morsefelder, Attorney for Waste Management of Minnesota was present. He reviewed what <br />went on at the meeting of October 23, 1990 and stated that Ordinance #90-5 was passed after <br />Waste Management applied for a CUP. Waste Management asked for a period of 4-1/2 years and <br />on that basis a public hearing was held.
