Motion Carried. Voting Yes: Chairperson Levine, Commissioners Bauer, Field, Brauer, Perez, <br />Schiller, and Van Scoy. Voting No: None. Absent: None. <br />Planning Consultant Goodroad reviewed the proposed revisions to Section 117.144a with regard <br />to the Special Requirements and Performance Standards for the B -1, B -2 and B -3 zoning <br />districts. She requested comment from the Commission on the proposed amendments. <br />Commissioner Van Scoy questioned what portion of the building Hope Fellowship occupied. He <br />did not feel it was necessary to have this restriction. <br />Development Services Manager Gladhill was not certain of the exact percentage, but knew it was <br />less than 50 %. He indicated the new standards would assist in reducing the need for conditional <br />uses. He noted there were less concerns in Commercial Districts than Business Districts for <br />places of assembly given the fact there were residential businesses. <br />Chairperson Levine asked how the Commission would like to proceed on this item. <br />Commissioner Brauer did not see a need for this restriction. <br />Planning Consultant Goodroad explained churches were moving from Residential zoning <br />districts to Business or Commercial districts. For this reason, the City needed to revise its code. <br />The percentage provision assured that multi -tenant buildings would not be overtaken by places of <br />assemblies. <br />Development Services Manager Gladhill noted places of assembly were not currently allowed in <br />Commercial Districts. The City was now allowing this use in Business Districts to meet the <br />needs of the City, while holding up to 20% of a multi -tenant building. <br />Further discussion ensured regarding the limitation within multi- tenant buildings. <br />Motion by Commissioner Bauer, seconded by Commissioner Van Scoy, to amend the City Code <br />draft for Section 117 -144a removing the 20% restriction for places of assembly in the B -1, B -2 <br />and B -3 zoning districts. <br />Further discussion <br />Commissioner Brauer asked if the City would be moving toward points based zoning or away <br />from this theory. He did not want to see the City becoming overly restrictive. He encouraged the <br />City to be flexible and allow for innovations. <br />Development Services Manager Gladhill indicated the City has been making efforts to create a <br />more user friendly Ordinance. He commented he would need additional training with regard to <br />the points based zoning system. He understood this offered additional flexibility, but would need <br />time and training in order to properly implement the new system. <br />Planning Commission /September 6, 2012 <br />Page 13 of 18 <br />
