conform to the requirements of this Section 5.3. If the <br />City rejects the Construction Plans in whole or in part, <br />Developer must submit new or corrected Construction <br />Plans within thirty (30) days after Developer's receipt of <br />the City's rejection notice. The provisions of this <br />Section 5.3 relating to approval, rejection and <br />resubmission of corrected Construction Plans shall <br />continue to apply until the City approves the <br />Construction Plans; provided, however, Developer may <br />not commence construction of the Minimum <br />Improvements until the City has approved or is deemed <br />to have approved the Construction Plans. Approval of <br />the Construction Plans by the City shall not relieve <br />Developer of any obligation to comply with the terms <br />and provisions of this Agreement or the provision of <br />applicable federal, state and local laws, ordinances and <br />regulations, nor shall the City's approval of the <br />Construction Plans constitute a waiver of any Event of <br />Default. If Developer desires to make any material <br />modification to the scope, size, appearance, value or use <br />of the Minimum Improvements or to the Final <br />Construction Plans after the City has approved the <br />Construction Plans and before Developer has <br />substantially completed the Minimum Improvements, <br />Developer must submit a description of the proposed <br />modification(s) and revised Construction Plans showing <br />the proposed modification(s) to the City for its approval. <br />If such material change in the Construction Plans <br />conforms to the approval criteria listed in this Section <br />5.3 with respect to the original Construction Plans, the <br />revised Construction Plans shall be deemed approved <br />unless the City notifies Developer that the City rejects <br />the revised Construction Plans in writing within thirty <br />(30) days after submission. If Developer desires to <br />make any change which does not materially modify the <br />scope, size, appearance, value or use of the Minimum <br />Improvements, Developer is not obligated to resubmit <br />the Construction Plans to the City for approval. <br />Section 5.4 Commencement and Completion of <br />Construction of the Minimum Improvements. <br />Developer must commence construction of the <br />Minimum Improvements on or before the <br />Commencement Date. Developer must substantially <br />complete the construction of the Minimum <br />Improvements in accordance with the Final Construction <br />Plans on or before the Completion Date.
