HRA Special Session
Date: 02/15/2011
By: Heidi Nelson
Administrative Services
Item #: 6. 1.
Information
Title:
Consider Amendment to the Development Management Agreement with Regard to the Hot List
Background:
Over the past year, the provision of the Development Management Contract that addresses the "Hot List" has been
discussed several times. At issue has been the ability of discussing the "Hot List" in closed session. The "Hot List"
is a document that lists the developers and end users that the Development Management Team is working with that
would be subject to incentive compensation per the terms of the contract. The Development Management Team has
been reluctant to allow for discussion of the "Hot List" at a public meeting in that all of the leads the team is
working with would become available to the public.
In an effort to define the developers/end users that would be considered for the "Hot List", staff has negotiated
language that would amend the Development Management contract. The amendment includes criteria that each of
the deals with developers/end users would have to meet before being considered for the "Hot List" and a process for
consideration and approval at the time the Development Management contract were terminated.
Attached to this case is the proposed amendment, DM contract, and previously approved first amendment.
Notification:
None Required.
Recommendation:
Review and consider proposed amendment to DM contract.
Funding Source:
DM Fees are paid from land sale proceeds.
Council Action:
Consider proposed amendment to DM contract.
Proposed Amendment re Hot List
First Amendment to DM Contract
DM Contract
Attachments
Form Review
Inbox Reviewed By Date
Heidi Nelson (Originator) Amy Dietl 02/09/2011 10:59 AM
Form Started By: Heidi Nelson Started On: 02/09/2011 09:40 AM
Final Approval Date: 02/09/2011
