CASE <br /> <br />REQUEST FOR A VARIANCE FROM STREET FRONTAGE REQUIREMENTS; <br />CASE OF DARYL PETERSON <br /> By: Acting Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />On December 21, 1989, the City of Ramsey received a letter from Daryl Peterson requesting that <br />the City of Ramsey sell a parcel identified as P.I.N. 10-32-25-44-0009 for him to consolidate with <br />parcel 10-32-25-44-0021. Staff investigation of parcel 10-32-25-44-0009 indicates that apparently <br />the City obtained this land parcel through tax forfeiture to insure possible access to P.I.N. 10-32- <br />25-44-0021. <br /> <br />On June 26, 1990, City Staff informed City Council that under the current density ordinance, only <br />one residential unit would be permitted on parcel 10-32-25-44-0021. However, in the event the <br />density zoning is amended in the future, the City should retain ownership of 10-32-25-44-0009 to <br />provide road right-of-way for the possible resubdivision of 10-32-25-44-0021. In the discussion <br />that followed, it was determined that an appropriate course of action would be for the City to grant <br />Mr. Daryl Peterson an easement across 10-32-25-44-0009 to allow for access to 10-32-25-44- <br />0021 from a public street. That easement would be in effect until the property is resubdivided and <br />platted in accordance with the City Code. In addition, the agreement for the easement would be <br />contingent upon Mr. Daryl Peterson making payment to the City of Ramsey in the amount of Four <br />Hundred Dollars ($400.00) for City expenses incurred in researching the possible sale of 10~32-25- <br />44-0009. At that meeting, Mr. Peterson was also informed that whether the City sold 10-32~25-44- <br />0009 for consolidation with 10-32-25-44-0021 or whether the City grants an easement across 10- <br />32-25-44-0009 to access 10-32-25-44-0021, a variance would be required from street frontage <br />requirements to market and develop the property as a buildable lot.
