PROPOSED FINDINGS OF FACT <br />VARIANCE: STREET FRONTAGE REQUIREMENTS <br />P.I.N. 10-32-25-44-0021 <br /> JULY 20, 1990 <br /> <br />1) <br /> <br />2) <br /> <br />3) <br /> <br />4) <br /> <br />5) <br /> <br />6) <br /> <br />7) <br /> <br />8) <br /> <br />9) <br /> <br />That Mr. Daryl Peterson, hereinafter referred to as "Applicant", has properly applied for a <br />variance from the street frontage requirements of Section 170.016A of the Ramsey City <br />Code. <br /> <br />That the Applicant appeared before the Board of Adjustment on July 26, 1990 for a public <br />hearing pursuant to Section 170.013G of the Ramsey City Code and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />That the Applicant is requesting a variance to the 200 foot street frontage requirement for a <br />landlocked ten acre parcel located West of Zirconium Street N.W. between 166th Lane <br />N.W. and 164th Lane N.W. The subject property is described as follows: <br /> <br />That part of the Southeast Quarter of the Southeast Quarter of Section 10, Township 32, <br />Range 25, Anoka County, Minnesota described as follows: <br /> <br />Commencing at the Southwest comer of said Southeast Quarter of the Southeast Quarter of <br />Section 10, thence North on the West line thereof to the Northwest comer thereof; thence <br />East on the North line thereof a distance of 710.70 feet; thence South and parallel with the <br />West line of said Southeast Quarter of the Southeast Quarter of Section 10 a distance of 420 <br />feet; thence West parallel with the North line thereof a distance of 217.94 feet; thence South <br />parallel with the said West line to the South line of the said Southeast Quarter of the <br />Southeast Quarter of Section 10; thence West along the said South line to the Southwest <br />corner thereof and back to the point of beginning, except the North 420 feet thereof. <br /> <br />That the only access to a public street from the subject parcel would be across P.I.N. 10-32- <br />25-44-0009, which parcel is owned by the City of Ramsey and would provide access to <br />166th Lane N.W. <br /> <br />On December 21, 1989, the City of Ramsey received a letter from Daryl Peterson dated <br />December 18, 1989 requesting the City of Ramsey to sell P.I.N. 10-32-25-44-0009 to him <br />for consolidation with P.I.N. 10-32-25-44-0021. <br /> <br />Staff investigation revealed that the City obtained P.I.N. 10-32-25-44-0009 through tax <br />forfeiture to insure future access to P.I.N.'s 10-32-25-44-0021, 0022 and 0018. <br /> <br />On June 26, 1990, upon City Staff recommendation, the City Council determined that in <br />the interest of maintaining an easement for future public road access to the subject area, it <br />would be appropriate for the City to retain ownership of P.I.N. 10-32-25-44-0009 and <br />grant Mr. Daryl Peterson an easement across that parcel to access 10-32-25-44-0021 until <br />such time as 10-32-25-44-0021 is subdivided and developed with public streets in <br />accordance with City Code. <br /> <br />Ramsey City Ordinance #89-33 implements 4 in 40 density zoning and restricts the subject <br />property to one buildable unit. <br /> <br />That City Code requires that street frontages in the rural area shall not be less than 200 feet. <br /> <br /> <br />
