· CASE #3:

REQUEST FOR A VARIANCE FROM REAR YARD SETBACK
REQUIREMENTS; CASE OF COATED ABRASIVE PRODUCTS COMPANY
(CAPCO), MR. PAUL BURZYNSKI
By: Acting Community Development Director Sylvia Frolik

Background:

Mr. Paul Burzynski is proposing a 5400 square foot expansion to the CAPCO manufacturing
facility located at 14059 Sunfish Lake Blvd. N.W. The proposed expansion is planned in
accordance with the dimensions and location of the existing facility on the subject property. The
existing facility was permitted to be developed in 1984 with a 20 foot mar yard setback. City Code
requires a 35 foot rear yard setback in the Industrial District. The expansion would also be
constructed with a 20 foot rear yard setback. According to City Code, because of the deficiency in
rear yard setback, the existing structure would be considered non-conforming. City Code requires
a variance to expand upon a non-conforming structure.

Observations:

The following items are enclosed for your information:

a) Site location map
b) Site plan
c) Proposed £mdings of fact
d) Proposed variance

Recommendation:

City Staff recommends approval of the request for a variance from rear yard setback requirements.

Board Action:

Motion to:
Adopt Findings of Fact __
setback requirements.

relating to CAPCO's request for a variance from rear yard

Motion to:
Approve/deny CAPCO's request for a variance from rear yard setback requirements.

Review Checklist:

City Administrator
City Attorney
City Engineer
Community Development Director

Chief of Police
Finance Officer
X Planning & Zoning Commission
X Building Official 'X
