Commissioner <br /> <br />moved the adoption of the following findings of fact: <br /> <br />PROPOSED FINDINGS OF FACT <br />VARIANCE: FRONT YARD SETBACK <br />PIN 13-32.25-21-0020 <br />16361 DYSPROSIUM STREET N.W. <br />August 15, 1990 <br /> <br />That Mr. Jack T. Mowry, hereinafter referred to as "Applicant", has properly applied for a <br />Board of Adjustment variance from Section 170.015G of the Ramsey City Code to <br />construct an accessory structure nearer the front property line than the principal sumcture on <br />the property generally known as 16361 Dysprosium Street N.W. and legally described as <br />follows: <br /> <br />Lot 2, Block 6, Barthel's Rum River Acres 2nd Addition, Anoka County, Mn <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 170.013G of the Ramsey City Code on August 23, 1990 and that said public <br />hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated as a pan of these findings by reference. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately 2.5 acres in <br />size. <br /> <br />4. That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Section 170.015G of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br /> <br />That the principal structure on the subject property is located 150 feet from the front <br />property line. <br /> <br />That the Applicant is proposing to construct an accessory structure on the subject property <br />approximately 90 feet from the front property line. <br /> <br />o <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district; namely, that the Applicant cannot consmact the <br />accessory smacmre in the rear yard and meet setback requirements from septic systems and <br />the Rum River and the Applicant cannot construct the accessory structure in the side yard <br />without altering the existing terrain by the addition of necessary fill and removing a <br />significant number of mature trees. <br /> <br />That such variance is necessary for the preservation of a substantial property right similar to <br />that possesed by other properties in the I- 1 Industrial District. <br /> <br />10. <br /> <br />That similar variances have been granted in the R-1 Rural Residential district in the City of <br />Ramsey. <br /> <br />10. <br /> <br />That the unique circumstances on the subject property do not result from the actions of the <br />Applicant. <br /> <br />11. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br /> <br />
