Commissioner moved the adoption of the following findings of fact: <br /> <br />o <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />VARIANCE <br /> <br /> PROPOSED FINDINGS OF FACT <br />FROM FRONT YARD SETBACK REQUIREMENTS <br /> PIN 22-32-25-22-0014 <br /> 15505 RAMSEY BLVD. N.W. <br /> <br />That Dorothy Schleper and the City of Ramsey, hereinafter referred to as "Applicants", <br />have properly applied for a Board of Adjustment variance from Section 170.016A of the <br />Ramsey City Code to relocate the dwelling unit to within the required front yard setback on <br />the property generally known as 15505 Ramsey Blvd. N.W. and legally described as <br />follows: <br /> <br />The South Half of the South Half of the South Half of the Northwest Quarter of the <br />Northwest Quarter of Section 22, Township 32, Range 25, Anoka County, <br />Minnesota, except road; subject to easement of record. <br /> <br />That the City Engineer, on behalf of the City of Ramsey and Dorothy Schleper, appeared <br />before the Board of Adjustment for a public hearing pursuant to Section 170.013G of the <br />Ramsey City Code on November 7, ~990 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />That the subject property is zoned R-1 Rural Residential and is approximately 4.5 acres in <br />size. <br /> <br />That the subject property is surrounded by R-1 Rural Residential zoning. <br /> <br />That Section 170.016A of the Ramsey City Code requires a forty (40) foot front yard <br />setback in the R-1 Rural Residential District. <br /> <br />That there are unique circumstances applying to the subject property that do not generally <br />apply to other properties in the district. Namely, that the City of Ramsey authorized <br />Improvement Project No. 89-4, the construction of an MSA street, which street will extend <br />153rd Avenue N.W. from County Road #5 to County Road #56. <br /> <br />That Dorothy $chleper owns land that is necessary for Project No. 89-4 fight-of-way and <br />the dwelling located on the subject property must be relocated on the property in order to <br />accommodate the right-of-way. <br /> <br />That the relocation of the dwelling on the subject property can be accomplished in a manner <br />which will meet the needs of the improvement project right-of-way if a ten (ten) foot <br />variance to the forty (40) foot front yard setback requirement is received. <br /> <br />That such variance is necessary for the improvement of the City of Ramsey's MSA <br />transportation routes and the preservation of a private property fight similar to that <br />possessed by other properties in the R-1 Rural Residential District. <br /> <br />That similar variances have been granted in the R-1 Rural Residential District in the City of <br />Ramsey. <br /> <br />That the unique circumstances on the subject property do no result from the actions of the <br />fee title owner of said property. <br /> <br /> <br />
