Mr. Hartley referred to a letter dated May 16, 1990 from Stephen J. BubuI of Holmes & <br />Graven; that letter highlights the importance of the Council determining that the application <br />meets the 'but for' test; a test which indicates that but for tax increment financing, the <br />development would not happen. Mr. Hartley noted that he has indicated to the applicant <br />that it is difficult to meet the 'but for' test at the same time as the development is moving <br />ahead. <br /> <br />Mr. Dennis Sharp stated that Parabody was attracted to his proposal because TIF <br />participation would be credited towards the lease/purchase price of the facility. Council's <br />decision on the TIF will be the determining factor as to whether or not the project will <br />proceed. <br /> <br />Councilmember DeLuca stated that he sees a situation where the facility will not be built <br />without TIF participation; if it is not built, Parabody will enter into a long term lease <br />somewhere else and the proposed development will not happen; the request therefore meets <br />the 'but for' test. <br /> <br />Mr. Harfley requested that Mr. Sharp produce documents for Council review that would <br />verify that the project is contingent upon TIF participation. <br /> <br />The case was temporarily tabled. Refer to Page 25 of these minutes for further action. <br /> <br />Case #15: <br /> <br />Application For Off-Sale Intoxicating Liquor License; Case Of <br />Ralph's Highway #I0 Liquor: <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to schedule a <br />public hearing for June 12, t990 at 7:30 p.m. to consider whether or not to approve an <br />application for an off-sale intoxicating liquor license from Ralph's Highway #10 Liquor. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson and <br />Peterson. Voting No: None. Absent: Councilmember Cich. <br /> <br />Case #16: Request For 3.2 Beer License At Central Park: <br /> <br />Mr. Hanley stated that the Ramsey Lions are requesting a 3.2 beer license at Central Park <br />on June 16, 1900 for the Ramsey Community Picnic. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to issue a <br />3.2 beer license to the Ramsey Lions for June 16, 1990. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson and <br />Peterson. Voting No: None. Absent: CouncilmemberCich. <br /> <br />Case #17: <br /> <br />Request For A Conditional Use Permit For Grading, <br />Excavating And Filling In The Trott Brook Floodway; Case of <br />Gene Moskop, Busse Construction, Inc.: <br /> <br />Planning Assistant Frolik stated that Anoka County has awarded a contract to Busse <br />Construction for improvements to County Road #83. The project includes excavating and <br />filling in the Trott Brook Floodway for which a conditional use permit is required in <br />accordance with the Flood Plain Management Ordinance.
