This, of course, is a corner stone of the U.S. <br />Constitution, the 1st Amendment, which guarantees freedom <br />of expression and speech. Enforcement of obscenity laws <br />then becomes a very difficult balancing act of what is <br />obscene (not legally permitted) versus what is <br />pornography (legally permitted). <br /> <br />Adopt appropriate licensing ordinances which regulate the <br />operation of adult book stores and perhaps other adult <br />entertainment establishments. <br /> <br />Study the effects of adult establishments and adopt what <br />are known as time, place and manner ordinances, which are <br />basically "content neutral" as to the material being sold <br />or viewed. Rather such regulations are aimed at the <br />secondary effects of adult entertainment businesses in <br />an attempt to prevent crime, protect the City's retail <br />property values, and protect and preserve the quality of <br />life in both the commercial and residential districts of <br />the City. Such ordinances regulate the siting of adult <br />establishments and when the criteria is not unreasonable, <br />have been found to be constitutional by the U.S. Supreme <br />Court. <br /> <br /> <br />
