§ 84.9256 <br /> <br />DEPARTMENT OF NATURAL RESOURCES <br /> <br /> Subd. 3. Prohibitions on owner. An owner of an all-terrain vehicle may not knowing- <br />ly allow it to be operated contrary to this section. <br /> Subd. 4. Suspension. When the judge of a juvenile court, or its duly authorized agent, <br />determines that a person, while less than 18 years of age, has violated sections 84.92 to <br />84.929, or other sUtte or local law or ordinance regulating the operation of an all-terrain <br />vehicle, the judge or duly authorized agent shall immediately report the determination to <br />the commissioner and (1) may recommend the suspension of the person's all-terrain <br />vehicle safety certificate, or (2) may recommend to the commissioner of public safety, the <br />suspension of the person's driver's license. The commissioner may suspend the certifi- <br /> <br />cate without a hearing. <br /> <br />Laws 1986, c. 452, § 18. Amended by Laws 1989, <br /> <br /> Historical Note <br />1989 Legislation <br /> The 1989 amendment rewrote subd. 1; in <br />subd. 2 increased thc age for requiring helmets <br />to persons less than "18" rather than persons <br />}ess than "16", expanded the helmet requirement <br />to operation of all-terrain vehicles on public wa- <br />ters or public road right, f-ways; and in subd. 3 <br />substituted "An owner" for "It is unlawful for <br />the owner" and "may not knowingly allow" for <br />"to permit". Subdivision 1 formerly read: <br /> "(a) Despite section 84.928 to the contrary, a <br />person under 12 years of age shall not make a <br />direct crossing of a trunk, county state-aid, or <br />counW highway as the operator of an all-terrain <br />vehicle, or operate the vehicle upon a street or <br />highway within a municipality. <br /> "0o) A person 12 years of age but less than 14 <br />years may make a direct crossing of a trunk, <br />county state-aid, or count5' highway only if that <br />person possesses a valid all-terrain vehicle safety <br />certificate and is accompanied by a person over <br />18 years of age or holding a valid driver's Ii- <br /> <br />c. 331, §§ 14 to 16. <br /> <br />cerise. A person under the age of 14 years' shall <br />not operate an all-terrain vehicle on public land <br />or water under the jurisdiction of the commis- <br />sioner unless accompanied by one of the follow- <br />ing listed persons on the same vehicle, if de- <br />signed for more than one person, or an accompa- <br />nying all-terrain vehicle: the person's parent, <br />legal guardian, or other person 18 years of age <br />or older or holding a valid driver's license. <br /> "However, a person 12 years of age or older <br />may operate an all-terrain vehicle on public lands <br />and waters under the jurisdiction of the commis- <br />sioner if that person possesses a valid all-terrain <br />vehicle safety certificate issued by the commis- <br />sioner. <br /> "(c) A person 14 years of age or older, but <br />less than 16 years of age, may make a direct <br />crossing of a trunk, county state-aid, or county. <br />highway only if that person possesses a valid <br />all-terrain vehicle safety certificate issued by the <br />commissioner or a valid motor vehicle operator's <br />license." <br /> <br />84.926. Vehicle use allowed on public lands by the commissioner <br /> On a case by case basis, after notice and public hearing, the commissioner may allow <br />vehicles on public trails under the commissioner's jurisdiction during specified times. <br /> <br />Laws 1984, c. 647, § 5, elf. Section 3 of Laws 1986, c. 444, provides <br />that the amendments "do not change the sub- <br />stance of the statutes amended." <br /> <br />84.927. Registration fees; unrefunded gasoline tax; allocation <br /> <br /> Subdivision 1. Registration revenue. Fees from the registration of all-terrain ve- <br />hicles and the' unrefunded gasoline tax attributable to all-terrain vehicle use under section <br />296.16 shall be deposited in the state treasury and credited to the all-terrain vehicle <br />account in the natural resources fund. <br /> Subd. 2. Purposes.
