Chairman Zimmerman noted that the public is opposed to the PUD concept based on the <br />fact that wetlands are already protected. <br /> <br />Mr. Hartley stated that if the Planning and Zoning Comn'fission wishes staff to discourage <br />PUDs, then the correct procedure would be for the Planning and Zoning Commission to <br />make that recommendation for a policy change to City Council. <br /> <br />Commissioner Shumway was opposed to establishing a policy discouraging PUDs because <br />there ma3' be situations where a PUD is appropriate. <br /> <br />Commissioner Hendriksen stated that he has an ongoing concern with issues that are tabled <br />for lack of information and brought back before the Commission without the requested <br />information. <br /> <br />Mr. Hartley stated that some of the City's problems in years past were the result of <br />inadequate or incorrect information; his policy is that nothing is placed on a meeting agenda <br />unless it is ready to be heard. <br /> <br />Commissioner Deemer stated that be was of the understanding that the correct procedure <br />was for Staff to make recommendations to the Planning Commission and following that, <br />the Staff should not have a position. <br /> <br />Mr. Hartley stated that the City Council has asked very specifically that they receive City <br />Staffs recommendation and most of the time that recommendation is consistents with those <br />of the various boards and commissions. If Staffs recommendation varies from that of the <br />board or commission, it will not change how City Council views an issue. <br /> <br />Mr. Harttey stated that a joint meeting on land use issues is being scheduled for March and <br />that would be an excellent time to discuss procedures. <br /> <br />NOTE PARK AND RECREATION COMMISSION MEETING MINUTES <br /> <br />The Commission noted the following: <br /> <br />1. City Attorney <br />Goodrich has indicated that he has not had a sufficient time frame in which to prepare a <br />legal opinion regarding this matter and requests that the case be tabled. <br /> <br />Mark Banwart referred to State Statute 473.806 which states that "no development shall be <br />allowed to occur within the area of a site or buffer area during the period of the <br />metropolitan development limitation without the approval of the (metro) council.
