20. That WMMI has stated that they have been acquiring property over <br /> the years to buffer the landfill and now own approximately 400 <br /> acres (9/8/88 hearing). <br /> <br />21. That Gateway North Industrial Airport is situated within 2600' of <br /> the proposed landfill expansion. <br /> <br />Borrow Area Activities <br /> <br />22. That in accord with City'Code 170.017M a conditional use permit <br /> for grading, mining and filling may be issued for a maximum period <br /> of three (3) years, after which a permit renewal is required. <br /> Permit renewals are processed as an original request for a condi- <br /> tional use permit. <br /> <br />23. That WMMI's borrow plan as submitted is divided into an east and <br /> west area consisting of 30 acres and 10 acres, respectively. <br /> <br />24. That WMMI has stated that the borrow operations would limit <br /> excavation to a minimum separation distance from ground water of <br /> 5'° or exceeding City Code of 6' above the elevation of the water <br /> table (9/8/88 public hearing). WM~I subsequently agreed to <br /> provide a minimum of 6' above the water table at all times. <br /> <br />25. WMMI has stated that they will limit operations to a minimum <br /> setback of 400' from adjacent properties on the west side and 200' <br /> setback from all other sides (case discussion 10/12/88). <br /> <br />26. That WMMI has stated that the approximate amount of material to be <br /> removed from the east borrow area is 400,000 yards and.150,000 <br /> yards from the west borrow area (9/8/88 public hearing). <br /> <br />27. That WI~MI has stated the drainage for the east borrow area would <br /> be to the east and that drainage for the west borrow area would be <br /> to the natural flow area that exists on that.portion of the site <br /> (9/14/88 public hearing). <br /> <br />Ski Hill/Rec Area <br /> <br />28. That the preliminary site plan submitted by WMMI indicates the ski <br /> hill development in concept and tha~ details of the development <br /> should be addressed through site plan review of the final <br /> development plans. <br /> <br />29. That WMMI stated that they currently ~re preparing plans for <br /> submission to MPCA for the ski hill design and environmental <br /> control in order that the vertical expansion can be reviewed in <br /> conjunction with the remedial action proposed on the site (9/8/88 <br /> public hearing). <br /> <br />30. That WMMI has stated that if the regulatory agencies reject the <br /> ski hill for environmental reasons, WMMI is prepared to dedicate <br /> 50 acres of land to the City for future recreation development in <br /> the area. as indicated on the plans (9/8/88 public hearing). <br /> <br />4 <br /> <br /> <br />
