Dorothy Stadfelt expressed concern regarding sewer and water coming into the area and the <br />residents of Rum Acre Estates being obligated to same. ~ <br /> <br />City Administrator Hartley indicated that Lot 1, Block 5, Rum Acre Estates cannot be <br />developed with sewer and water because it is outside the MUSA area. <br /> <br />Discussion ensued between City Administrator Hartley and Mr. Knutson regarding the <br />various options available to resolve the drainage issue. <br /> <br />Dorothy Stadfelt and Shirley Chenoweth both repeated that they want Lot 1, Block 5, Rum <br />Acre Estates restored as a natural ponding area without the use of storm sewer. <br /> <br />City Administrator Hartley also noted that if the owner of Lot 1, Block 5, Rum Acre <br />Estates could provide for drainage that is acceptable to the City, he maintains all property <br />rights. <br /> <br />Jean Schlueter stated that due to Mr. Raatikka's error, Mr. Miller has the opportunity to <br />provide for alternative drainage and develop the lot prematurely. <br /> <br />Mayor Reimann asked for a consensus of the City Council as to which option should be <br />selected to resolve the drainage issue. <br /> <br />Councilmember DeLuca stated there are legal issues to be addressed before making any <br />decisions. <br /> <br />City Council directed City Staff to obtain legal opinion regarding the City's liability in the <br />event the ponding area is restored and doesn't function. <br /> <br />Councilmember Cich inquired if the drainage easement would be retained or would the lot <br />be considered buildable if the storm sewer was installed and the lot was restored to it <br />original elevation. <br /> <br />Bruce Schlueter noted that the original elevation was below street level. <br /> <br />Motion by Councilmember DeLuca and seconded by Councitmember Pearson to table any <br />action regarding the drainage issue in Juniper Woods and directed the City Attorney to <br />report back to City Council regarding City liability associated with the option for drainage <br />presented by the City Engineer. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None.
