Case #1: <br /> <br />REQUEST FOR CONDITIONAL USE PERMIT TO ESTABLIStt A YARI) WAS'FE <br />COMPOST SITE; CASE OF WASTE MANAGEMENT OF MINNESOTA, INC. <br /> By: Mark S. Banwart, Communily Development Director <br /> <br />Background: <br /> <br />Waste Management of Minnesota, Inc. is requesting a conditional use permit (CUP) to establish a <br />yard waste compost facility at the Anoka Regional Sanitary Landfill site. The proposed facility <br />would accept leaves, grass and tree prunings. The estimated annual capacity of the facility would <br />be 23,200 tons per year. The site size would be approximately .>~.4 acres. Tile property is <br />generally known as 14730 Sunfish Lake Boulevard N.W. and legally described as tile Southeast <br />Quarter of the Northeast Quarter of Section 27, Township 32, Range 25, Anoka County, <br />Minnesota. The P.1.N. is 27-32-25-14-0001. For your information, the following items are <br />enclosed: <br /> <br />A. Site location map <br />B. Public hearing notice (January 24,. 1990) <br />C. Anoka Regional Composting Facility Proposal 0anuary 16, 1990) <br /> <br />Observations: <br /> <br />On January 16, 1990, the City of Ramsey received the application and CUP proposal from Waste <br />Management of Minnesota, Inc. to establish a yard waste compost site. <br /> <br />The location of the proposed yard waste compost site is located in the buffer area for the landfill <br />candidate site "P". <br /> <br />According to Minnesota Statutes <br />DEVELOPMENT LIMITATIONS.] <br />APPROVAL REQUIRED.] <br /> <br />§473.806 [INVENTORY OF DISPOSAL SITES; <br /> Subdivision 1. [(METROPOLITAN) COUNCIL <br /> <br />..."No development shall be allowed to occur within the area of a site or buffer area during <br />the period of the metropolitan development limitation without the approval of the council. <br />No county, city, or town land use control shall permit development which has not been <br />approved by the council, nor shall any county, city, or town sanction or approve any <br />subdivision, permit, license, or other authorization which would allow development to <br />occur which has not been approved by the council."... <br /> <br />Recommendation: <br /> <br />Staff recommends pursuant to §473.806 the issue of a conditional use permit should be tabled until <br />which time Waste Management of Minnesota, Inc. has received approval from Metropolitan <br />Council. Only at that time should the City of Ramsey proceed with a more detailed evaluation of <br />the CUP request and the development of the Findings of Fact and proposed conditional use permit. <br /> <br />Commission Action: <br /> <br />Motion to table Waste Management of Minnesota, Inc.'s request for a conditional use permit to <br />establish a yard waste compost site. <br /> <br />Review Checklist: <br /> <br />City Administrator X <br />City Attorney X <br />City Engineer .
