Motion by Commissioner Deemer to recommend that City Council approve the preliminary plat of
Tooth Acres, as modified with outlots, contingent upon City Council entertaining the thought that
Outlots B and E, purchased by Anoka County, be deeded back to the City of Ramsey for park and
public use for the following reasons: a) to assure protection of the City of Ramsey's interest in a
north/south trail corridor and a Mississippi River bridge crossing corridor;, and 2) to satisfy park
dedication requirements.

Further Discussion: Commissioner Hendriksen reiterated that the proposed subdivision has not
been reviewed by the Park and Recreation Commission and inquired as to why action on the
subdivision is so urgent. Mr. Banwart replied that the County will not pay Mr. Martin until the
plat is recorded; the longer plat approval takes at the City level, the more it is costing Mr. Martin to
provide for a Mississippi River bridge crossing. Commissioner Shumway stated that the plat
should not be forwarded to City Council until the Park Commission has reviewed it. Mark
Banwart noted that the southern portion of the property is being condemned; what is of interest to
the City is the northern portion of the property, Outlots A, B and C; 3 lots constitute a minor
subdivisions; minor subdivisions are not required to be reviewed by the Planning Commission or
the the Parks Commission but the City Staff subjects them to those reviews to avoid problems;
designation of the lots as A and C means that they cannot be developed; they will surely be
resubdivided into developable lots in the future and at that time it would be appropriate to require
park dedication. Commissioner Hendriksen requested that the motion be amended to reflect a
contingency of an acceptable park dedication agreement being reached between the City of Ramsey
and Anoka County.

Commissioner Deemer restated his motion as follows:

Motion by Commissioner Deemer to recommend that City Council approve the preliminary plat of
Tooth Acres, as modified with outlots, contingent upon an acceptable park dedication agreement
being reached between the City of Ramsey and Anoka County, which should included entertaining
the thought that Outlots B and E, purchased by Anoka County, bedeeded back to the City of
Ramsey for park and public use for the following reasons: a) to assure protection of the City of
Ramsey's interest in a north/south trail corridor and a Mississippi River bridge crossing corridor;,
and 2) to satisfy park dedication requirements.

Further Discussion: Commissioner Hendriksen suggested that a recess be called and that legal
advice be sought. Chairman Zimmerman noted that the recording secretary would not be available
following a recess. Commissioner LaDue stated that in his opinion, this matter is not a major issue
and the Commission should vote on the motion and let Anoka County develop it's regional park.

Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Deemer and
Shumway. Voting No: Commissioner Hendriksen. Absent: Commissioners Bawden and Terry.

Planning & Zoning Commission/January 23, 1990
Page 4 of 5
