PAUL, MN 55106 "~" <br /> <br />PHONE NO. 296- 7523 FILE NO. <br /> <br />October 12, 1989 <br /> <br />Mr. Jeffrey Caine <br />Caine & Associates Land Surveyors <br />17720 Highway 65 <br />Ham Lake, MN 55304 <br /> <br />RE: SKETCH PLAN FOR TROTT BROOK PONDS, PROTECTED WETLAND 2-323W, <br /> CITY OF RAMSEY, 'ANOKA COUNTY <br /> <br />Dear Mr. Caine: <br /> <br />Based on my review of your sketch plan and on my October 4, 1989 <br />field inspection of the site in question, I have the following <br />comments relating to Trott Brook Ponds. <br /> <br />The ordinary high water level (OHW) of wetland 2-323W exists at <br />approximately elevation 871.0'. Minnesota Rules, part 6115.0190, <br />subpart 3 prohibits the placement of fill to create upland areas; <br />and prohibits fill to construct roadways or pathways, or to create <br />or improve land accesses from peripheral shorelands to islands; or <br />to facilitate land transportation across the waters. A road project <br />can be proposed, however, by a federal, state or local government <br />agency. The fill prohibition may be waived provided that: <br /> <br />1) <br /> <br />2) <br /> <br />there is no other feasible or practical alternative to the <br />project that would have less environmental impact; and <br />the public need for the project rules out the no-build <br />alternative. <br /> <br />Since there is upland to the north of the wetland, in the northeast <br />corner, there is a feasible and prac6ical alternative to the wetland <br />crossing as sho~m on the plan. This rule would also eliminate any <br />possibility of filling as proposed in Lot 23, Block 3. <br /> <br />AN EQUAL OPPORTUNITY EMPLOYER <br /> <br /> <br />
