10.26 the applicant is listed in the criminal gang investigative data <br />10.27 system under section 299C.091, the person may challenge the <br />10.28 denial, after disclosure under court supervision of the reason <br />10.29 for that listing, based on grounds that the person: <br />10.30 (1) was erroneously identified as a person in the data <br />10.31 system; <br />10.32 (2) was improperly included in the data system according to <br />10.33 the criteria outlined in section 299C.091, subdivision 2, <br />10.34 paragraph (b); or <br />10.35 (3) has demonstrably withdrawn from the activities and <br />10.36 associations that led to inclusion in the data system. <br />11.1 (d) If the court grants a petition brought under paragraph <br />11.2 (a), the court must award the applicant or permit holder <br />11.3 reasonable costs and expenses including attorney fees. <br />11.4 Sec. 9. Minnesota Statutes 2004, section 624.714, <br />11.5 subdivision 17, as reenacted by section 1, is amended to read: <br />11.6 Subd. 17. [POSTING; TRESPASS.] (a) A person carrying a <br />11.7 firearm on or about his or her person or clothes under a permit <br />11.8 or otherwise who remains at a private establishment knowing <br />that <br />11.9 the operator of the establishment or its agent has made a <br />11.10 reasonable request that firearms not be brought into the <br />11.11 establishment may be ordered to leave the premises. A person <br />11.12 who fails to leave when so requested is guilty of a petty <br />11.13 misdemeanor. The fine for a first offense must not exceed $25. <br />11.14 Notwithstanding section 609.531, a firearm carried in violation <br />11.15 of this subdivision is not subject to forfeiture. <br />11.16 (b) As used in this subdivision, the terms in this <br />11.17 paragraph have the meanings given. <br />11.18 (1) "Reasonable request" means a request made under the <br />11.19 following circumstances: <br />11.20 (i) the requester has prominently posted a conspicuous sign <br />11.21 at every entrance to the establishment containing the following <br />11.22 language: "(INDICATE IDENTITY OF OPERATOR) BANS GUNS IN <br />THESE <br />11.23 PREMISES."; and or <br />11.24 (ii) the requester or its the requester's agent personally <br />11.25 informs the person of the posted request that guns are <br />11.26 prohibited in the premises and demands compliance. <br />28 <br />
