CONDITIONAL <br /> <br /> PROPOSED FINDINGS OF FACT <br />USE PERMIT: AUTO REPAIR IN AN R-IR RURAL <br /> RESIDENTIAL DISTRICT <br /> 17600 GIBBON STREET N.W. <br /> P.I.N. 05-32-25-41-0002 <br /> AUGUST 1, 1990 <br /> <br />1) <br /> <br />2) <br /> <br />3) <br /> <br />4) <br /> <br />5) <br /> <br />6) <br /> <br />7) <br /> <br />8) <br /> <br />9) <br /> <br />10) <br /> <br />11) <br /> <br />12) <br /> <br />13) <br /> <br />That Mr. Craig Johnson, hereinafter referred to as "Applicant", has property applied for a <br />conditional use permit to operate an auto repair business in the R-1 Rural Residential <br />district on the property generally known as 17600 Gibbon Street N.W. and legally <br />described as follows: <br /> <br />Lot 5, Block 1, Deerwood, Anoka County, Minnesota. <br /> <br />That the subject property is approximately 2.5 acres in size and located in the R-1 Rural <br />Residential District. <br /> <br />That Section 170.01 of the Ramsey City Code does not permit auto repair shops in the R-1 <br />Rural Residential District. <br /> <br />That the adjacent properties are zoned R-1 Rural Residential. <br /> <br />That the City of Ramsey has issued one other conditional use permit in the R-1 Rural <br />Residential District for an auto repair business that had been operating on the subject <br />property for 18 years prior to the date of application. That conditional use permit was <br />granted on the basis of the City Council's determination that the subject property deserved <br />some consideration under pm-existing non-conforming use rights. <br /> <br />That the City has received 8 responses from area residents indicating no opposition to the <br />request for a conditional use permit for an auto repair business and some on the <br />contingency that the operation be limited to one or two cars at any given time; and the City <br />has received 2 responses from area residents stating opposition to the request. <br /> <br />That the proposed use will/will not increase traffic into and from the premises. <br /> <br />That the proposed use will/will not be unduly dangerous or otherwise detrimental to <br />persons residing or working in the vicinity of the use or to the public welfare. <br /> <br />That the proposed use will/will not substantially adversely impair the use, enjoyment or <br />market value of surrounding property. <br /> <br />That the proposed use will not be harmonious and in accordance with the specific <br />objectives of the comprehensive plan. <br /> <br />That the proposed use will/will not change the essential character of the area. <br /> <br />That the proposed use will/will not be disturbing to existing or future neighboring uses. <br /> <br />That the proposed use will not be a substantial improvement to property in the immediate <br />vicinity and the community as a whole. <br /> <br /> <br />
