It is expected that the Kelly Property will be acquired by Anoka <br />County for County Park purposes and a street connection to that <br />property would be undesirable. The Subdivision Sketch Plan <br />proposes continuation of the existing 35 foot road easement along <br />the westerly Schwartzman property to serve the Kelly property as it <br />has in the past. The easement is the only public land access to <br />the property. In the event the Kelly property is not acquired by <br />the County the owners will negotiate a change in the access as <br />necessary. <br /> <br />OUTLOT <br /> <br />The outlot is intended for use as a private open space area to be <br />owned by an owners association which provides owners with a passive <br />recreation area, River access and space for the storm water <br />retention area. As such the developer claims partial park <br />dedication credit for this area. <br /> <br />RESIDENTIAL LOT SIZE <br /> <br />Ail single family lots as proposed will exceed the 12,150 s.f. <br />minimum area as specified in City Code Sec. 170.016B for the R-1U <br />Residential District and also as specified in the Environmental <br />Protection Ordinance ~88-11 for non-riparian lots with public <br />sewer. (The Outlot is a "riparian lot" that borders the <br />Mississippi River watercourse.) All residential lots are <br />considered as "non-riparian" lots. The Interim Regulations for the <br />Mississippi River Critical Area do not have lots size requirements <br />but simply refer to the "local zoning ordinance". <br /> <br />RESIDENTIAL LOT WIDTH <br /> <br />Lot width requirements for single family residential lots are <br />specified in City Code Sec. 170.016B for the R-1U Residential <br />District as a minimum of 80 feet. All lots are proposed in excess <br />of this minimum. The Environmental Protection Ordinance #88-11 <br />indicates a lot width minimum of 90 feet "at the Building Line and <br />River Frontage" which applies to riparian lots. The Interim <br />Regulations for the Mississippi River Critical Area do not have lot <br />width requirements. <br /> <br />2 <br /> <br /> <br />
