It is expected that the Kelly Property will be acquired by Anoka
County for County Park purposes and a street connection to that
property would be undesirable. The Subdivision Sketch Plan
proposes continuation of the existing 35 foot road easement along
the westerly Schwartzman property to serve the Kelly property as it
has in the past. The easement is the only public land access to
the property. In the event the Kelly property is not acquired by
the County the owners will negotiate a change in the access as
necessary.

OUTLOT

The outlot is intended for use as a private open space area to be
owned by an owners association which provides owners with a passive
recreation area, River access and space for the storm water
retention area. As such the developer claims partial park
dedication credit for this area.

RESIDENTIAL LOT SIZE

Ail single family lots as proposed will exceed the 12,150 s.f.
minimum area as specified in City Code Sec. 170.016B for the R-1U
Residential District and also as specified in the Environmental
Protection Ordinance ~88-11 for non-riparian lots with public
sewer. (The Outlot is a "riparian lot" that borders the
Mississippi River watercourse.) All residential lots are
considered as "non-riparian" lots. The Interim Regulations for the
Mississippi River Critical Area do not have lots size requirements
but simply refer to the "local zoning ordinance".

RESIDENTIAL LOT WIDTH

Lot width requirements for single family residential lots are
specified in City Code Sec. 170.016B for the R-1U Residential
District as a minimum of 80 feet. All lots are proposed in excess
of this minimum. The Environmental Protection Ordinance #88-11
indicates a lot width minimum of 90 feet "at the Building Line and
River Frontage" which applies to riparian lots. The Interim
Regulations for the Mississippi River Critical Area do not have lot
width requirements.

2
