Application for CUP
Aluminum Recycling, Inc.
by: Merland Otto

Background:

The Planning and Zoning Commission held a public hearing on
November 20, 1990 and acted on findings of fact and a CUP. The
case was tabled until December 6, 1990 for final action pending the
City Attorney's review to determine whether the proposed facility
was a solid waste management facility under Ordinance 90-5 and any
review comments he might have on the conditions of the CUP.

The central point of discussion is whether the drop off/recycling
operation accepts "waste" or whether recyclable materials in an
unprocessed state are not waste. It is the Staff's opinion that
recyclable materials are waste unless the material is being
processed with a resulting end product being produced on the site.
The attachments would seem to support this concept. In particular,
from the KAB recycling manual, in the section on Paper Recycling
it states, "Keep in mind that collection is only the first step in
recycling. Recycling takes place when waste paper is used as a raw
material to make a new product and during that process the waste
paper loses its identity."

The Minnesota Waste Management Act (115.A.02) specifically mentions
separation and recovery of materials, waste recycling as waste
manaqement practices. (underlining added (see attachments).

Also attached are definitions from MPCA rules 7035.0300. You'll
note that the solid waste definition of Ordinance 90-5 is the same
as that of 7035.0300 subp. 100. You will further find "waste"
defined in Subp. 112 referencing MS 115A.03 Subd. 34.

The Anoka Co. Recycling directory lists Aluminum Recycling, Inc.
and indicates materials being received (attached).

In summary, enclosed for your information are:

!)

Excerpts from - !15A Waste Management Act
MN Rules 7035.0300 - Definitions
MS 115A.03 Subd 34 - Definitions
Metropolitan Council Definitions from
Solid Waste Management Guide
KAB Mult: Material Recycling Manual

2)

Anoka County Recycling Directory
Recycling Opportunities in Metro Area

Findings of Fact as of 11/20/90.

CUP as of 11/20/90.
