DeLuca, Pearson and Bawden. Voting No: None.

~ Re~uest_J~or ?:inor Subdivisio:~ Case Of Er. John Gobern~tz:

Mr. Raatikka stated that Mr. Gobernatz is requesting a minor subdivision of
a 2.5 acre and a 37.5 acre lot south of 177th Avenue° Planning and Zoning
expressed concerns with the iegallity of 177th as a public road; City
records indicate that it is owned by the City. The City has maintained the
road for at lea~t 16 years; it is not up te City [tandards; upgrading
should be accomplished under petition or Chapter 429.

Mr. Goodrich stated that he believed the roadway is in the County's title
even though the auditor shows that the City has ownership; he will follow
up on that issue.

Coune. il amended the proposed resolution as follow~:

Add an item indicating that the developer shall provide for park
dedication requirements in accordance with current park dedication
ordinance.

Add an item indicating that the developer shall provide an additional
27 feet of right-of-way adjacent to Hwy. f!47 for future upgrading°

Add an item indicating that the developer will enter into a
development agreement with the City.

Motion by Councilmember Sorteberg and seconded by Councilmember ~,awden to
adopt Resolution f~88-221 approving Mr. John Gobernatz' request for a minor
subdivision.

Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg,
DeLuca, Pearson and Bawden. Voting No: None.

Case

Review Sketch Plan Of _C_edar H~li~ With Resoect To Road
Access:

Mr. Otto stated that the proposed plat of Cedar Hills consists of
approximately 136 single family lots. In addition, there are two other
proposed subdivisions in the area that consist of another 94 lots
approximately. Residents of Hunter's Hill, Ramsey Terrace and F!intwood
Hills are concerned with the plats as the traffic from all three areas
would exit via: 144th Avenue to the west; 142nd through Windemere Estates
te Dysprosium and south to Cry. Rd. ~t16; extension of Magnesium Street to
Cry. Rd. f~i16. Planning and Zoning tabled preliminary plat of Cedar Hills
and requested that City Council declare it's intent for working with the
developer to acquire an access route fror, the southwest portion of Cedar
Hills to Cty. Rd. ~116. City Staff is of the opinion that another access
is needed but it is a developer responsibility.

Mr. Goodrich advised Council to use it's right to condemn property
sparingly even though the right has been used to develop an MSA road in the
past.
City Council/November 15, 1988

?age 14 cf !5
