N.W., Ramsay, Minnesota regarding proposed improvements to Wac o <br />Street N.W. north of 179th Lane N.W. <br /> <br />Members Present: <br /> <br />Mayor Gary Hcimann, Ramsay <br />Councilmember A1 Pearson, Ramsay <br />Councilmember David Bawden, Ramsay <br />Councilmember Stephen F. DeLuca, Ramsey <br />Bruce Olson, Burns <br />Dennis Berg, Burns <br />Ernie Koehler, Burns <br /> <br />Also Present: <br /> <br />City Administrator David Hartley <br />City Engineer Peter Raatikka <br /> <br />Members Absent: Councilmember A1 Sorteberg <br /> <br />.QALL TO .Q~DER <br /> <br />Mayor Reimann called the public hearing to order at 7:40 p.m. and led in <br />the Pledge of Allegiance to the Flag. <br /> <br />pRESENTATION <br /> <br />Mr. Hartley stated that the purpose of the public hearing is to receive <br />comments in favor of and opposed to a proposed improvement project to Waco <br />Street N.W. north of 179th Lane. <br /> <br />Mr. Hartley explained that the laws applying to Ramsey are different than <br />those that apply to Burns. Ramsey is a home rule city and has a charter <br />which spells out procedures for public improvements. Burns Township is an <br />urban township and public improvements for that township fall under <br />Minnesota Statute 429. The procedure for 429 is that if there are 33% of <br />the front footage represented by a petition, than the township must <br />consider whether or not to do a public improvement. Chapter 429 also <br />requires a public hearing. In Ramsey, the same number of signatures are <br />required to consider a public improvement but for the public improvement <br />to go forward, there are different requirements. If there is opposition to <br />the improvement, then the number of signatures on the favoring petition <br />have to be greater than the number of signatures on the opposing petition. <br />Those that are permitted to sign a petition are persons who are property <br />owners; one signature per property owner is all that is permitted, <br />regardless of how much property is owned in the subject area. <br /> <br />Mr. Hartley stated that Ramsey has received a petition opposing the <br />proposed improvement project that contains names cf individuals in Ramsey <br />Public Hearing/December 8, 1988 <br /> <br />Page 1 of 6 <br /> <br /> <br />
