Voting No: None. <br /> <br />Case #7: Discussion Regarding Park Dedication For John Gobernatz Minor <br /> Subdivision: <br /> <br />Mr. Banwart stated that the main concern with the current park dedication ordinance is that the <br />park dedication requirement refers to subdivisions and includes resubdivisions. City Staff has <br />determined that since Mr. Gobernatz' minor subdivision was approved by the Planning <br />Commission prior to lhe adoption of the new park dedication ordinance, his park dedication <br />requirement could be determined based on the previous ordinance. Under the previous <br />ordinance, Mr. Gobernatz would be obligaled to pay park dedication on the building permit issued <br />for the new lot. Any future resubdivision of the property would be subject to the current <br />ordinance regarding park dedication. <br /> <br />Mr. Gobernatz stated that he is willing to pay his fair share of park dedication; that he is willing <br />to be considered under the ordinance but he does not want to pay park dedication on a recurring <br />basis. Mr. Gobernatz staled that he has contacted the attorney at the League of Minnesols Cities <br />and in their opinion, recurring park dedication fees is unusual. <br /> <br />Mr. Goodrich noted that State statute allows cities to charge park dedication anytime there is a <br />subdivision, <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson directing City Staff <br />to research park dedication requirements at the League of Minnesota Cities and report back to <br />City Council on January 24, 1989. At 1hat time, there should aisc be information available <br />from the Park and Recreation Commission regarding park dedication. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #8: Response To Anoka County Court System Regarding Relocating <br /> Municipal Trials: <br /> <br />Mr. Goodrich stated that the Anoka County Court Administrator has determined that all <br />municipal court trials, except those for the City of Anoka, will be conducted at the Columbia <br />Heights facility. The additional dis;ance for officers and city attornies to travel impacts the <br />time and cost involved in court trials. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cich directing that the Mayor <br />forward a letter to the Anoka County Chief Judge, Anoka Count), Clerk of Court and Anoka County <br />Commissioner Steffen expressing Ramsey's disappointment with the determination that all <br />municipal trials will be conducted at the Columbia Heights facility. <br /> <br />Motion carried.
