19. Proof of Authority. When the PERMITTEE is a corporation, the CITY requires proof of authority <br />by the corporation to execute this Development Permit. <br />20. Violation of This Permit. If the PERMITTEE fails to perform any of the terms of this Permit in the <br />manner required by the City, the City shall be entitled to recover, from the PERMITTEE or the issuer <br />of PERMITTEE financial guarantee, such amount of any and all financial guarantees that are needed <br />to compensate CITY for actual damages incurred as a result of such breach. Breach of any of the terms <br />of this Development Permit by the PERMITTEE shall also be grounds for denial of Building Permit <br />or issuance of Certificate of Occupancy. <br />21. Agreement Binding On Successors and Assigns. The PERMITTEE agrees that this Development <br />Permit shall be binding upon its successors and assigns. <br />22. Impacted Public Improvements. The Permittee shall promptly return any material to the CITY that <br />is required to be removed as a result of the construction of the entrance to the Subject Property (the <br />"Entrance").
