CASE #5:

REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE A
WASTE TIRE PROCESSING/MANUFACTURING FACILITY
ON INDUSTRIALLY ZONED PROPERTY;
CASE OF WASTE MANAGEMENT OF MINNESOTA, INC.
By: Merland Otto and Sylvia Frolik

Background:

Waste Management of Minnesota, Inc. has purchased a portable tire shredder which they are
intending to use at the Anoka Regional Sanitary Landfill for the processing of tires. It is the
position of Mr. Miller of Waste Management of Minnesota, Inc., that waste tire recycling is really a
manufacturing operation which is a permitted use in the I-I Industrial zone. Mr. Hartley and Mr.
Goodrich have reviewed the matter and agree that the City Code does not permit waste tire
recycling facilities in industrially zoned areas of Ramsey, nor does the existing conditional use
permit held by WMMI. On February 22, 1989, WMMI did apply for a conditional use permit.

The tire processing facility is proposed to be located east of the active filling operations at the
Anoka Regional Sanitary Landfill. The waste tires are proposed to be stored on the ground
adjacent to the shredder; no more than 70,000 tires will be stored on-site at any time. The facility
would be open to the public as well as commercial haulers. The tire shredder has a capacity to
shred 1,200 car tires or 300 truck tires per hour. The tire chips (2"x2") would be temporarily
stored or directly loaded into 20-ton capacity trucks. It is estimated that three 20-ton truckloads per
day wal transport the shredded materials from the site.

A permit application for operation of the proposed waste tire processing facility has also been
submitted to the Anoka County Environmental Health Department and MPCA. MPCA has
approved the application on a provisional status. The provisional status does not release WMMI
from any liability, penalty or duty imposed by State, Federal or local ordinances. MPCA has
indicated that the processing facility permit for the Anoka Landf'fll Tire Processing Facility will not
be isst~ed until all local ordinances have been met or a schedule of compliance can be established.

The following items are enclosed for your information:

a) Application
b) Site location map
c) Public hearing notice
d) Properties notified
e) Excerpts from WMMI's application to MPCA dated November 16, 1988.
f) Anoka County draft license conditions
g) Proposed findings of fact
h) Proposed conditional use permit (will be available at the meeting)

Recommendation:

Commission Action:

Motion to:
Recommend that City Council adopt findings of fact relating to Waste Management of
Minnesota, Inc.'s request for a conditional use permit to operate a waste tire recycling
center.
