Case

MUSA EXCHANGE - 1990 AMENDMENT
By: Merland Otto

Background:

City Council directed staff at the March 28, 1989 Council meeting
to proceed with negotiations with Metro Council so that an exchange
of the MUSA could move forward.

After consultation with MC staff, the City formally requested a
temporary delay on action on the MUSA 2000 amendment submitted
January 26, 1989. This request was transmitted by letter on April
11, 1989. A copy of the letter is attached.

A separate amendment has been prepared which proposes an exchange
of approximately 165 acres. The proposed exchange allows for Cedar
Hills, Chestnut Hills, and Juniper Ridge to be included in the 1990
MUSA and removes Ramsey Terrace, Flintwood Hills, Pondvale Estates,
and an area east of Pondvale Estates from the. 1990 MUSA as shown
on the attached Figure.

The document requesting the exchange was submitted to MC on April
17 after meeting with MC staff on April 14, 1989. MC has indicated
that t heir review and action should be completed in 30 to 60 days.

Observations:

No Commission action is required at this time.

A public hearing must be held on the proposed amendment. The
Planning and Zoning Commission is holding the hearing tonight.
Comments will be considered and if appropriate, will supplement the
submittal to MC for their consideration.

Recommendation:

Staff recommends that the Commission approve the proposed MUSA
exchange.

Commission Action:

Motion to: Approve/modify the proposed 1990 MUSA configuration.

Review Checklist:

city Administrator x
city Attorney x
city Engineer x
Community Development Dir. x

Chief of Police
Finance Officer
Public Works Supt.
Other
