CASE #11: <br /> <br />REVIEW DRAFT SWIMMING POOL AND SPA ORDINANCE <br /> By: Glyn II. Huff, B,,ilding Official <br /> <br />Backgronnd: <br /> <br />There is an increasing number of residential swimming pools and spas being <br />constructed within the City of Ramsey. Swimming pools and spas are inherently <br />dangerous unless properly secured. They can also be considered a nuisance by <br />neighbors if certain zoning requirements are not followed during and after <br />construction. Our current swimming pool regulation is addressed on page 31 <br />(City Code 170.015G) and consists of one paragraph: <br /> <br />Every private inground swimming pool or commercial fishing pond shall <br />be enclosed by a fence or wall not less than four (4') feet high to prevent <br />uncontrolled access by small children. <br /> <br />For your information, the following item is enclosed: <br /> <br />A. Proposed Swimming Pool and Spa Ordinance <br /> <br />Observations: <br /> <br />With a more comprehensive pool/spa ordinance, the City may be able to protect the <br />property owner by placing the pool or spa in such a way that would not interfere <br />with accessibility to utilities on the property. By controlling placement of the pool <br />or spa on a lot the City will positively contribute to the health, welfare and quality <br />of life of its citizens. On April 25, 1989, Ramsey City Council introduced the <br />Swimming Pool and Spa Ordinance with a change in the temporary fencing <br />section to not include above ground swimming pools. <br /> <br />Recommendations: <br /> <br />Staff recommends that the Planning and Zoning Commission advise City Council <br />to conduct a public hearing to adopt the Swimming Pool and Spa Ordinance. <br /> <br />Commission Action: <br /> <br />Motion to recommend/not recommend that the City Council adopt the proposed <br />Swimming Pool and Spa Ordinance. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Attorney ..X <br />City Engineer <br />Community Development Director .X <br /> <br />Chief of Police <br />Finance Officer <br />Planning & Zoning Comm. <br />Building Official <br /> <br />X <br /> <br /> <br />
