CASE #10: <br /> <br />REQUEST TO REZONE THE PROPOSED PLAT OF CHESTNUT HILLS <br /> FROM R-1 RURAL RESIDENTIAL TO R-1 URBAN RESIDENTIAL; <br /> CASE OF MR. JOHN PETERSON; GOOD VALUE HOMES <br /> <br />Background: <br /> <br />Mr. John Peterson is requesting approval to rezone the proposed plat of Chestnut Hills from R-1 <br />Rural Residential to R-1 Urban Residential. The subject property is approximately 56 acres in size <br />and is located to the northwest of Ramsey Terrace. <br /> <br />In October of 1988, Mr. Peterson submitted a subdivision application to the City, proposing the <br />extension of sewer and water utilities and developing the property with 102 single family <br />residential lots. Although the subject property is in the Urban Area, it is not within the 1990 <br />Urban Area. To extend municipal services to the proposed Chestnut Hills would require an <br />amendment to the Comprehensive Plan for an expansion of the MUSA boundaries. On January <br />26, 1989, the City submitted a formal application to the Metropolitan Council for a MUSA <br />expansion. Indications from Metro Council are that on July 13, 1989, the City can expect to <br />receive formal approval of it's application for a Comprehensive Plan amendment to expand the <br />MUSA boundary. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Application <br />Site location map <br />Public hearing notice <br />Properties notified <br />Proposed findings of fact <br />Proposed ordinance <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of Mr. John Peterson's request for rezoning contingent upon final <br />approval of Ramsey's request for a Comprehensive Plan amendment. <br /> <br />Commission Action: <br /> <br />Motion to: <br />Recommend that City Council adopt the findings of fact relating to Mr. John Peterson's <br />request to rezone the proposed Chestnut Hills from R-1 Rural Residential to R-1 Urban <br />Residential. <br /> <br />-and- <br /> <br />Motion to: <br />Recommend that City Council approve/deny Mr. John Peterson's request to rezone the <br />proposed Chestnut Hills from R-1 Rural Residential to R-1 Urban Residential contingent <br />upon final approval of Ramsey's request for a Comprehensive Plan amendment. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Attorney <br />City Engineer <br />Community Development Director <br /> <br /> Chief of Police <br /> Finance Officer <br /> Planning & Zoning Commission <br />X Planing Assistant X <br /> <br /> <br />
