City for cancelled abatements when at least twenty-four (24) hours prior <br />notice by the City has been given to the Contractor. <br />8. Performance: Should the Contractor fail to appear for an appointed <br />abatement at the scheduled time, the City reserves the right to call <br />another abatement Contractor to perform the work. <br />In the event that at any time, it becomes necessary for the City to request <br />the services of another Contractor for the reasons detailed above, the City <br />reserves the right to hold the Contractor responsible for any additional <br />charges at the rate of charges agreed upon in the Contractor's Contract <br />with the City. Any additional charges shall be assessed only if the <br />response time is due to negligence on the part of the Contractor, which <br />negligence may include equipment failure. <br />If the Contractor is called and is unable to respond due to conditions <br />beyond its control, the authorized City officials shall be immediately so <br />informed, and the right is hereby reserved to call another contractor to <br />perform the work. <br />9. Storage Facility: The Contractor shall operate and maintain a storage <br />facility for all Abated Property in compliance with the terms of this contract <br />and all State and City applicable laws, ordinances, rules and regulations <br />that are presently in effect or which may hereafter be adopted. Pursuant <br />to Ramsey City Code Section 2-332, unclaimed property and vehicles are <br />eligible for disposal or sale fifteen (15 days) after the abatement, subject <br />to Minnesota Chapter 168B titled "Abandoned Motor Vehicles," when <br />applicable. <br />10. Reclaiming Property: Within 15 days of the abatement, the property <br />owner can reclaim any items held by paying all fees incurred by the City <br />associated with the abatement. Contractor shall be permitted to schedule <br />appointments with the property owner during normal business hours for <br />purposes of property owner's retrieval of Abated Property. The Contractor <br />will invoice the City for all expenses associated with the Abatement prior <br />to releasing any items to the property owner. The property owner will pay <br />the fees directly to the City, and not the Contractor. <br />11. In the event of a breach by the Contractor of any terms or conditions of the <br />Contract, the City shall have, in addition to any other legal recourse, the <br />right to terminate the Contract immediately. <br />12. Either party may terminate the Contract without cause upon the serving of <br />such termination notice to the other, in writing, thirty (30) days prior to the <br />intended termination date. <br />13. A copy of the Contract(s) shall be readily available for inspection at the <br />Contractor's place of business. <br />4 <br />
