DRAFT LRRWMO JOINT POWERS AGREEMENT AMENDMENT May 2013 <br />AMENDMENT TO JOINT AND COOPERATIVE AGREEMENT FOR THE <br />ESTABLISHMENT OF THE LOWER RUM RIVER WATERSHED MANAGEMENT <br />ORGANIZATION TO PLAN, CONTROL AND PROVIDE FOR THE DEVELOPMENT OF <br />THE LOWER RUM RIVER WATERSHED <br />THIS AMENDMENT is made and entered into as of the date of execution by all of the <br />cities of Andover, Anoka, Coon Rapids and Ramsey, Minnesota (hereinafter collectively referred <br />to as the "Parties"). <br />WITNESSETH: <br />WHEREAS, the Parties entered into a Joint Powers Agreement entitled the JOINT AND <br />COOPERATIVE AGREEMENT FOR THE ESTABLISHMENT OF THE LOWER RUM <br />RIVER WATERSHED MANAGEMENT ORGANIZATION TO PLAN, CONTROL AND <br />PROVIDE FOR THE DEVELOPMENT OF THE LOWER RUM RIVER WATERSHED (the <br />"Joint Powers Agreement"); and <br />WHEREAS, the Joint Powers Agreement established the Lower Rum River Watershed <br />Management Commission (the "Commission"), a watershed management organization pursuant <br />to and in accordance with the Metropolitan Surface Water Management Act, Minn. Stat. § <br />103B.201, et seq., and Minn. Stat. § 471.59; and <br />WHEREAS, the Joint Powers Agreement, as amended, expires by its terms on January 1, <br />2015; and <br />WHEREAS, the Parties have determined that it is reasonable, prudent and in the best <br />interest of the public to extend the term of the Joint Powers Agreement as hereinafter provided. <br />NOW, THEREFORE, on the basis of the premises and mutual covenants and agreements <br />hereinafter set forth, the Parties agree as follows: <br />1. Article X, Subdivision 1 of the Joint Powers Agreement is amended to read as <br />follows: <br />Subdivision 1. Each member agrees to be bound by the terms of this agreement <br />until January 1, 2025, and it may be continued thereafter at the option of the <br />Parties. <br />2. Article X, Subdivision 2 of the Joint Powers Agreement is amended to read as <br />follows: <br />Subdivision 2. This agreement may be terminated prior to January 1, 2025, by <br />the unanimous consent of the members or if for any reason the Commission is <br />reduced to less than three members.
