This sui)d]vision is <br />being considered as a minor subdixqsion. The total acreage is 26.24 acres. The existing hind use <br />is Rural Residential/Agricultural use. The future land use is anticipated to remain the same. <br />The proposed subdivision is a re-subdivision of Lot 2, Block 1, Gordon's Gardens Addition. Lewandowstd (July 17, 1989) <br />City Engineer's review (August 29, 1989) <br /> <br />Observations: <br /> <br />At the May 2, 1989 Planning and Zoning Commission meeting, Mr. Harley Gordon stated that in <br />his discussions with Anoka Count), Department of Transportation they indicated that the <br />upgrading of an existing access from County Road #22 for the proposed Lots I and 2 was <br />acceptable. However, they had reservations about allowing an additional driveway access from <br />Count), Road #22 to Lot 3. Rather, Anoka County would prefer the extension of 180th Avenue <br />Northwest to gain access to Lot 4, Block 1. Anoka CourtW has also stated that if access cannot be <br />obtained from 180th Avenue Northwest to Lot 4, Block 1, the), would consider an additional <br />driveway access from Count)' Road #22. <br /> <br />On May 2, 1989, the Ramsey Planning and Zoning Commission requested the City Attorney to <br />determine the feasibility and cost responsibiliW of condemnation to extend 180th Avenue <br />Northwest and then to obtain City Council direction on same. The CiW Attorney adwises that <br />eminent domain is most likely acceptable and the public purpose requirements can be met by <br />sho~5ng the necessity of the road in allo~-ing for the best and highest use of the land. Furthermore, <br />the CiW Attorney's opinion is the costs incurred for the eminent domain procedure should be borne <br />by the benefitting developer. According to Mr. Harle)' Gordon, the asking price for the se~oment of <br />land needed to extend 180th Avenue Northwes; was stated to be six thousand dollars ($6,000.00). <br />The cost of eminent domain could likely approach that amount. However, the negotiated purchase <br />of the needed land considering vacation of a portion of the existing cuI-de-sac could be <br />substantially less. <br /> <br />On May 11, 1989, the Ramsey Park and Recreation Commission recommended the acceptance of <br />cash to satisfy the park dedication since no parks or trails are proposed for this area. <br /> <br />On May 23, 1989, City Council directed City Staff to proceed with the negotiated purchase of <br />necessary lands for the extension of 180th Avenue Northwest and to proceed in the event of <br />successful purchase, the vacation of portions of the cul-de-sac, which would become unnecessary in <br />the event of the street extension. The subdivider of Gordon's Gardens 2nd Addition would assume <br />financial responsibility for the negotiated purchase and also the restoration of the cul-de-sac prior <br /> <br /> <br />
