Sales. <br /> <br />The Commission proceeded to review Ms. Frolik's memo dated 3ulv 26, 1989 which <br />indicated that the applicants are in violation of their existing conditional use permit. The <br />Commission noted that according to: Mr. Gocdhch's memo of July 26, 1989, thc City does <br />not have the authority to require financial security to be utilized f~r conditiona; use permit <br />enforcement activities. The Commission then reviewed the corrected site plv. n which now <br />indicates location of existing septic system, alternate septic system lo:.ation and num ~ber of <br />employees at the site. <br /> <br />Commissioner Hendriksen stated that in addition to the current status of conditional use <br />permit compliance, he intended for the history of vic,;ations at the site to be reported so thal <br />the), could be addressed in the findings of fac~ relating to the request for an expansion. <br /> <br />Mr. Banwarl noted that the applicants have received approval from Mn/DOT for two <br />accesses onto Hwy. #10; City Staff is recommending one access to Hwy. #10 from the <br />westerly boundary of the property. <br /> <br />Commissioner Hendriksen noted that the vehicle sales lot attracts public during off- <br />business hours; the accesses to the business are blocked and people park in the County and <br />State road right-of-way. <br /> <br />Mr. Banwart noted that parking along State and County right-of-ways is a major problem <br />in the entire Hwy. #10 Corridor and suggested that the City intiate a request at the County <br />and State levels to post 'no parking' signs. <br /> <br />Mr. Banwart also noted that City Staff is recommending that the 3 parcels involved be <br />consolidated into one tax parcel. <br /> <br />The Commission proceeded to review the proposed findings of fact. <br /> <br />Motion by Commissioner Deemer and seconded by Chairman Zimmerman to amend Item <br />#14 of the proposed findings of fact to indicate that the applicant is proposing two accesses <br />onto Hwy. #10 if the expansion is approved. <br /> <br />Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, Deemer <br />and Bawden. Voting No: None. Absent: Commissioners Shumway, LaDue and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to amend Item <br />#17 of the proposed findings of fact to indicate that the applicant is proposing to increase <br />the total amount of vehicle display/customer parking spaces from 57 to 140. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, Deemer <br />and Bawden. Voting No: None. Absent: Commissioners Shumway, LaDue and Terry. <br /> <br />Motion by Commissioner Bawden and seconded by Commissioner Deemer to amend Item <br />#21 of the proposed findings of fact to indicate that the proposed expansion will not be <br />unduly dangerous to persons residing or working in the vicinity. <br /> <br />Further Discussion: Commissioner Deemer stated that the business will be dangerous to <br />the public unless off-street par'king is provided during off-business hours.
