C~mnissioner inquired if dedication of park land applied in this case. Mr. Dorm replied that with a PUD, if 20% or more of the land is used for public purposes no park land dedication is necessary. Commissioner Schneider inquired if the money obtained from the sale of park land would be deposited in the City Park Fund. Mr. Schnelle replied that it would be. Motion by Commissioner Schneider to recommend preliminary approval of Fir. Bill Dorm's proposed planned unit development based on the findings of fact and the recommendations of City Engineer, City Staff and Planning and Zoning Commission. Commissioner Deemer seconded the motion for further discussion. ~urther Discussion: Commissioner Deemer stated that the motion should include wording to the effect that the sale of .the City property shall not be for an amount less than that to be the determined worth of the property at the time of it's donation to the City as park land. Commissioner Schneider amended her motion to included that wording. Commissioner Deemer seconded the amendment to the motion. Motion carried. Voting Yes: Chairman Peterson, Co~missioners Kennen, Z{mmerman, Deemer, Schneider, Isakson and LaDue. Voting No: None. Case ~3: .Proposed Critical Area And Wetlands Ordinance: ~airman Peterson noted that a Variance Procedure should be added to the Ordinance.and in the case of Mr. Martin, if present conditions continue to exist the Planning and Zoning Commission goes on record as recommending that Mr. M~rtin be allowed furture subdivision into two lots. Co~nissioner Schneider inquired if Mr. Martin felt secure in that his concerns were answered by the Planning C~mission. Mr. M~rtin replied that he accepts P&Z's interpretation of the ordinance. Commissioner Schneider recommended that 'Mr. Martin review 'of the minutes of this meeting and that he also approach City Council with his concerns. ~. Schnelle noted that ~. Martin's written presentation stfunitted at this meeting will be included in the Council agenda. Conm~issioner Schneider stated appreciates Mr. Martin's feasible problems regarding a tract of land along 139th but considering Fr. F~.~tin does own additional adjacent acreage, at this po//4t she does not want to go on record as being in favor of granting Mr. M~vtin a variance for future subdivision. Cc~m~ssioner Schneider stated that she is in favor of variance procedure being included in the ordinance.
