Motion carried. Voting Yes: Acting Chairman Hendriksen, Commissioners LaDue, <br />Deemer and Ten-5.'. Voting No: None. Absent: Chairman Zimmem-mn, Commissioners <br />Shumway and Bawden. <br /> <br />Andria Hillebregt - 16926 Bison Street N.W. - Stated that she would not like to see Bison <br />constructed as a through street to access Trott Brook Ridge; a through street is not <br />necessary and it would destroy the character of the area. <br /> <br />Commissioner Hendriksen indicated that anytime there is a situation of the road or <br />casement abutting a property line, which is the case with Bison, it is typically an indication <br />that the road was intended to be a through street at some point in the future to provide <br />access to the next developing parcel. <br /> <br />Al Shallbetter - 16970 Bison Street N.W. - Stated that he doesn't think the City properly <br />notified people in the area about the proposed plat and public hearing; he and a majority of <br />the residences on Bison did not receive notification of the public hearing and several homes <br />on Zeolite Street that are not affected by the plat did. The Cit',' recently considered paving <br />Bison from 171st to Cry. Road #63; that and the portion of Bison being discussed at this <br />time should be paved all at once. A1 inquired as to who initiated the petition to pave Bison. <br /> <br />Mr. Banwart stated that petitions are initiated by the affected property owners. <br /> <br />A1 Shallbetter - Requested an explanation of the proposed trail system. <br /> <br />Mr. Banwart stated that the standard the City is pursuing with respect to trails is a 75 foot <br />wide corridor, but in this case wider than 75 feet because of Trott Brook. The trail would <br />consist of a 8 foot v,,ide bituminous path and an additional undeveloped type of path for <br />horseback riding. The trail itself has to be located on usable ground. Regarding <br />notification of public hearing, the State Statute requires the City not/fy all properties within <br />350 feet of the boundaries of the proposed project; if parcels immediately adjacent to the <br />proposed project area are 350 feet deep or deeper, the parcels beyond would most likely not <br />receive notification. <br /> <br />A1 Shallbetter - Stated that he understands that Bison Street was misaligned on the north <br />end and inquired as to who is responsible for the cost of realignment to it's correct <br />position. <br /> <br />Mr. Banwart replied that the abutting property owners from 171st to Ct.','. Rd. #63 are <br />responsible for the realignment of Bison Street. <br /> <br />Al Shallbetter - Inquired as to why it wouldn't be easier to ~andfather Bison Street into it's <br />current position. <br /> <br />Mr. Banwart replied that in some cases, streets are ~andfathered into their used position; in <br />this particular case, a number of parcels were torrenced and the judge ruled that when the <br />street is improved, it ',,,,ill be brought into the City's right-of-way. <br /> <br />Dee Anderley - 16917 Bison Street N.W. - Stated that she has lived in the area for 22 3'ears <br />and she is opposed and sees no point to extending Bison as a through street as there are <br />several other accesses that could be used by the developer of Trott Brook Ridge. <br /> <br />Planning & Zoning Commission Public Hearin~ovember 6, 1989 <br /> Page 2 of 3 <br /> <br /> <br />
