Case #11: <br /> <br />Request To Rezone The Proposed Plat Of tteatherwood ttills <br />From R-1 Rural Residential To Planned Unit Development; <br />Case Of Hokanson Construclion: <br /> <br />Mark Banwart stated that the proposed pla! of Heatherwood Hills will meet the PUD 20% <br />open space requirement. At the Planning and Zoning Commission public hearing, the <br />owners of Duff and Towle Estates to the north expressed concerned that the proposed <br />layout of Heatherwood Hills will landlock their 5 acre parcel if and when this area is <br />redeveloper at urban standards. Mark Banwart noted that the proposed plat of <br />Heatherwood Hills will be returned to the Planning and Zoning Commission for an <br />additional re¥iew prior to it being subn'fitted to City Council for final plat approve. <br /> <br />Shawn Towle - 16400 St. Francis Blvd. N.W. - Noted that a r~etition containing 51 <br />signatures was submitted to the City opposing the request for rezoning the proposed plat of <br />Heatherwood Hills to PUD. <br /> <br />Mr. Goodrich read the petition out loud. <br /> <br />Shawn Towle - Stated that he and surrounding property owners are of the opinion that <br />including wetlands in the computation of the average density of the plat offsets the integrity <br />of the proposed development. The surrounding property owners are also concerned with <br />allowing an.',, access from the proposed plat onto Hwy. #47 because of the dangerous <br />visibility aspects of that area of Hwy. #47. The residents also feel that the,,, were not <br />adequately heard and that the Planning and Zoning Commission gave the r]evetoping <br />agency, a non-residential entity, a higher priority. The residents want to see the 2.5 acre <br />m/nimum lot size maintained in this area. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to adopt <br />Findings of Fact #0270 relating to Mr. Kirk Corson's request to rezone the proposed plat <br />of Heatherwood Hills from R-i Rural Residential to Planned Unit Development, amended <br />to include a fact indicating that the City did receive a petition from surrounding property <br />owners opposing the request for rezoning and a fact indicating that the City Council is <br />recommending that the developer provide an easement from the end of the cul-de-sac north <br />to Duff and Towle Estates for future access purposes. <br /> <br />Further Discussion: Shawn Towle stated that he questions the fact that originally this <br />subject property was zoned for 9 units in 1985; the original request from Hokanson <br />Construction was for 29 units and now that has been increased to 46 units. Shawn Towle <br />inquired as to what has happened in the last 4 years, other than the drought, that would <br />support the proposed development and the increase in number of proposed units. Mark <br />Banwart stated that the PUD concept is the reason for the difference in allowable units. <br />Mark Banwart stated that the resolution adopted earlier this evening spells out-the PUD <br />policy and it states that there has to be a minimum of 27,000 square feet of Class I soils and <br />that will be the determining factor as to which lots are buildabte and which are not. <br />Councilmember Cich inquired about the concerns with access onto Hwy. #47. Mark <br />Banwart replied that Mn/DOT is reviewing the proposed access onto Hwy. g47. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councitmembers DeLuca, Pearson, Cich <br />and Peterson.
