$4,890 payment to the Elofsons. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember DeLuca to <br />direct the City Attorney to prepare an amendment to the Elofson Easement <br />Agreement deleting the conson of the commercial entrances by the City in <br />exchange for a $4,890 payment to the Elof$ons and authoirze the Mayor and <br />City Administrator to sign the amendment° <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, <br />DeLuca, Pearson and B~wden. Voting No: None. <br /> <br />Request For~A~ QQnd~J~ional p~e Permit To Have A Business <br /> Identification Si~n In The R-IR Residential District: Case <br /> Of Mr. Stnnle? Morton: <br /> <br />Mr. Banwart stated that Mr. ~orton is requesting a conditional use permit <br />to have a 32 square foot sign on his nursery stock sales lot at 16355 St~ <br />Francis Blvd. N.W. Planning and Zoning recommended approval of the <br />request; City Staff is recommending denial based on the fact that the area <br />is zoned Residential. <br /> <br />Motion by Councilmember Bawden and seconded by Councilmember Pearson to <br />adopt Findings of Fact #0238 relating to Mr. Stanley Morton's request for a <br />conditional use permit. <br /> <br />Further Discussion: Mr. Banwart noted that the sign size should be in <br />accordance with the provisions in the conditional use permit ordinance for <br />home occupations. Mr. Banwart also noted that there may be a number of <br />other non-complying signs in the Residential area and the City is getting <br />into the enforcement mode on that issue and also reviewing the sign <br />ordinance. Mr. Morton stated that the zoning is Residential but his parcel <br />is 10 acres in size and has the appearance of an Agriculture district. <br /> <br />Motion carried. Voting Yes: Motion carried. Voting Yes: Mayor Reimann, <br />Councilmembers $orteberg, DeLuca, Pearson and Bawden. Voting No: None. <br /> <br />Motion by Councilmember Bawden and seconded by Councilmember Pearson to <br />approve Mr. Stanley Morton's request for a conditional use permit. <br /> <br />Further Discussion: Mr. Goodrich noted that the Council is setting a <br />precedent. Counci!member DeLuca inquired if advertising the sale of <br />agricultural products is separate enough from a commercial business so that <br />Council would not be setting a precedent. Mr. Hartley replied that there <br />is nothing that says the city must permit a sign for the selling of <br />agricultural products. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, <br />DeLuca, Pearson and Bawden.
