Liability <br /> <br />2) <br /> <br />That the private ownership and maintenance of the <br />open space is adequately provided for by written <br />agreement; and <br /> <br />3) <br /> <br />That the private open space is restricted for park <br />and recreational purposes by recorded covenants <br />which run with the land in favor of the future <br />owners of property within the tract and which cannot <br />be eliminated without the consent of the City <br />Council; and <br /> <br />4; <br /> <br />That the proposed private open space is reasonably <br />adaptable for use for park and recreational <br />purposes, taking into consideration such factors as <br />size, shape, topography, geology, access and <br />location of the private open space land; and <br /> <br />5) <br /> <br />That facilities proposed for the open space are in <br />substantial accordance with the provisions of the <br />recreational element of the comprehensive plan, and <br />are approved by the city Council; and <br /> <br />6) <br /> <br />That where such credit is granted for privately <br />owned/public use park and recreation facilities, the <br />amount of credit shall not exceed twenty-five <br />percent (25%) of the amount which otherwise would <br />be required for parkland dedication. <br /> <br />7) <br /> <br />That where such credit is granted for privately <br />owned/private use park and recreation facilities, <br />the amount of credit shall not exceed twelve percent <br />(12%) of the amount which otherwise would be <br />required for parkland dedication. <br /> <br />Pond Areas <br /> <br />Where ponding has been determined to have a park <br />function, credit will be given at a rate of 25% for the <br />pond and adjoining land area below the ordinary high <br />water level; a minimum of 70% of land above the high <br />water mark shall be dedicated before pond credit is <br />granted. Other city park dedication policies relating <br />to pond dedication must also be complied with. <br /> <br />Scenic easements <br /> <br />In appropriate plats, as determined-by agreement between <br />the city Council and the subdivider, the subdivider may <br />dedicate to the public a scenic easement in combination <br />with the requirements of Sections 170.062 and 170.063 <br />above or, if the subdivider and City Council agree, the <br /> <br /> <br />
