Case #6: <br /> <br />Request Council Direction Regarding Possible Condemnalion Of <br />Land Adjacent "I'o The Proposed Gordon's Gardens 2nd Addition: <br /> <br />Mr. Banwart stated that Mr. Gordon is proposing to develop Gordon's Gardens 2nd Additi,m. <br />The Anoka County Department of Transportation has reviewed the sketch plan and indicated that <br />upgrading an existing driveway onto County Road #22 to se~,e Lots I and 2 is acceptable. The <br />County, City Staff and the Planning and Zoning Commission would prefer the extension of 180th <br />Avenue N.~V. versus allowing an additional driveway onto Ct.','. Rd. #22 to access Lot 4. Mr. <br />Gordon has indicated that the property owner is willing to sell thc easement for an extension of <br />180th Avenue at a substantial price. On Ma5, 2, tile Planning and Zoning Commission requested <br />that the City Staff determine the feasibility and cost responsibility for condemnation. The City <br />Attorney has determine3 that condemnation is within the realm of City efforts; cost of <br />condemnation would be the responsibility of the subdivider; and in this case, the cost of <br />condemnation could approach that of the asking price. It is recommended that Cip,' Council direct <br />City Staff to assis~ in a negotiated purchase of tile easement necessars.' for the extension of 180th <br />Avenue N.W. If that effort fails, Mr. Gordon can determine if hc wishes to proceed by requesting <br />condemnation of the easement. <br /> <br />Councilmember DcLuca noted that it might also be of benefit to have Mr. Gordon dedicate <br />ea. ~.m,..nts to the south boundary of Gordon's Gardens 2nd Addition that could eventually provide <br />a connection to Ermine Blvd. N.W., should it become necessary in the future. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Peterson to direct City Staff <br />to proceed with the negotiated purchase of necessaU, lands for the extension of 180th Avenue <br />N.W. and to proceed in the event of successful purchase, the vacation of portions of the cul-de- <br />sac, which would bt come unnecessaD, in the event of the extension of 180th Avenue N.W. <br />Furthermore, the subdivider would assume financial responsibility for the negotiated purchase and <br />would also ~ financially responsible for the restoration of the cul-de-sac prior to vacation to those <br />benefitting property owners residing outside of the proposed subdivision as part of the <br />Development Ag-reement for Gordo's Gardens 2nd Addition. <br /> <br />Further Discussion: Mr. Gordon stated that he is agreeable to providing easements for the <br />continued extension of t 80th Avenue to the south. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich and <br />Peterson. Voting No: None. <br /> <br />Case #7: Amended Development Permit For Custom Coach RV, Inc.: <br /> <br />Mr. Banwa.rt stated that on March 14, the Cit.',' ~anted site plan approval to Custom Coach to <br />remodel and add onto an existing building located at 6845 Hwy. gl0 N.V,;., formerly the <br />McGregor's Truck Stop. On April 5, the City was advised by Custom Coach that certain soils had <br />been contaminated by petrolium products leaking from under~ound storage tanks and lines prior <br />to the time they acquired the site. On May 10, Custom Coach indicated that the), wanted to prore~ <br />with the ariSition and remodeling to the buiiding but desired some relief from the site plan time <br />schedule i..': consideration of the fact that the site, at a later date, may require excavation because of <br />die contaminated soils. Based on this information, City Staff is recommending approval of an <br />amended development permit for Custom Coach. <br /> <br />Motion by Councilmember Pearson and seconded by Councilmember Peterson to approve the <br />amended development permit for Custom Coach RV, Inc. <br /> <br />City Council/May 23, 1989 <br />Page 8 of 14 <br /> <br /> <br />
