Motion camed. Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, LaDue, <br />Terry, Bawden, Deemer and Shumway. Voting No: None. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to add an <br />Item #15 indicating that no provision of the conditional use permit agreement shall <br />grandfather the use should the City make more restrictive ordinances governing this <br />specific use. <br /> <br />Further Discussion: The consensus of the Commission was that the City Attorney should <br />review this proposed item for legallity. Commissioner Shumway noted that it has been the <br />consensus of this Commission in the past that grandfather laws are not bad; that they have <br />protected a lot of people for a lot of years. Commissioner Bawden noted that it is not <br />unusal for the City to require uses to comply with laws that may change periodically. <br />Chairman Zimmerman noted that ordinances apply to the City in general; conditional use <br />pem~its are a rezoning for which the conditions are established at the time. Commissioner <br />Hendriksen stated that the property owner is being allowed to operate a facility which <br />would not normally be allowed under the current zoning; if the property were located in a <br />zone which permitted used auto sales, the operation would be required to comply with <br />additional ordinances as they were enacted. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, <br />Hendriksen, LaDue, Bawden and Terry. Voting No: Commissioner Shumway. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Terry, to amend Item <br />#11 to delete the second sentence explaining the purpose in prohibiting exterior storage of <br />inoperable vehicles, vehicle parts, etc. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, <br />Hendriksen, LaDue, Bawden, Terry and Shumway. Voting No: None. <br /> <br />The consensus was that Item #5 should include language requiring that the landscaping also <br />be maintained. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to add an Item <br />#16 allowing for the annual inspection and review of the conditional use permit. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, <br />Hendriksen, LaDue, Bawden, Terry and Shumway. Voting No: None. <br /> <br />Motion by Commissioner Bawden and seconded by Commissioner Shumway to <br />recommend that the City Council rescind the conditional use permit issued in 1988 and <br />issue an amended conditional use permit, as proposed, for the entire site of the Ramsey <br />Auto Sales. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, <br />Hendriksen, LaDue, Bawden, Terry and Shumway.
